The Permanent Forum welcomes resolution 176 EX/59 of the UNESCO Executive Council relating to indigenous languages and encourages member States, experts and UNESCO to conduct a preliminary study on the technical and judicial aspects of a possible international normative instrument for the protection of indigenous languages and languages under threat of extinction, including an analysis of the programmes UNESCO has carried out in this area, articulating linkages with the United Nations Declaration on the Rights of Indigenous Peoples, as adopted by the Human Rights Council in June 2006, to be submitted to the Executive Council of UNESCO at its 179th session.

Effective access to justice for indigenous peoples implies access to both the State legal system and their own systems of justice. Without accessible State courts or other legal mechanisms through which they can protect their rights, indigenous peoples become vulnerable to actions that threaten their lands, natural resources, cultures, sacred sites and livelihoods. Concurrently, the recognition of indigenous peoples’ own justice systems is pivotal in ensuring their rights to maintain their autonomy, culture and traditions.

The Permanent Forum calls upon UNESCO, the Secretariat of the Conference on Biological Diversity, UNDP, the United Nations Children’s Fund (UNICEF), the United Nations Population Fund, the World Intellectual Property Organization and the United Nations Development Group to support indigenous peoples in their process of cultural heritage restoration and strengthening. This process should be guided by indigenous peoples in order to avoid the misuse and distortion of indigenous peoples’ culture, practices and knowledge and to respect their perspectives and aspirations.

The Permanent Forum recommends that States, relevant United Nations agencies and other intergovernmental organizations and bilateral donors support strategies for intercultural prevention and eradication of violence against women that are designed and driven by indigenous women’s organizations and that consider indigenous approaches to address gender-based violence.

The Permanent Forum welcomes the recommendations of the international expert workshop on the World Heritage Convention and indigenous peoples, held in Copenhagen on 20 and 21 September 2012, and the anticipated establishment by the World Heritage Committee of a consultative body on the Operational Guidelines for the Implementation of the World Heritage Convention during its thirty-seventh session, to be held in Phnom Penh from 17 to 27 June 2013, in order to consider, among others, revisions to the guidelines relating to the human rights of indigenous peoples, including the principle of free, prior and informed consent. The Forum recommends that UNESCO and the World Heritage Committee implement the Convention in accordance with the rights enshrined in the United Nations Declaration on the Rights of Indigenous Peoples, taking an approach based on human rights. The Forum members will endeavour to participate in the thirty-seventh session of the Committee, including the meetings of the consultative body on the Operational Guidelines, as observers.

It is stated in article 4 of the Declaration that “Indigenous peoples, in exercising their right to self-determination, have the right to autonomy or self-government in matters relating to their internal and local affairs, as well as ways and means of financing their autonomous functions”. The Permanent Forum welcomes the international seminar to assess the global status and trends with regard to indigenous autonomies, held in Mexico City in March 2019, which was organized by the Inter- American Commission on Human Rights, the Special Rapporteur on the rights of indigenous peoples, the Expert Mechanism on the Rights of Indigenous Peoples, the Permanent Forum and the International Work Group for Indigenous Affairs. The Forum calls upon States and United Nations entities to continue to discuss these issues in each region. The Forum also encourages the convening of a global conference on the state of indigenous autonomies by the three United Nations mechanisms on the rights of indigenous peoples (i.e., the Forum, the Special Rapporteur and the Expert Mechanism) and invites Member States to host the event.
