The Permanent Forum reiterates its concern about conservation efforts, including the designation of national parks, biosphere reserves and world heritage sites, which frequently lead to the displacement of indigenous peoples from their traditional lands and territories. In this regard, the Permanent Forum requests that a member of the Forum attend the thirty-fourth session of the UNESCO World Heritage Committee, to be held in Brasilia, Brazil, in August 2010.

The Permanent Forum recommends that the United Nations Educational, Scientific and Cultural Organization (UNESCO) and the International Fund for Agricultural Development (IFAD) establish an institutional partnership with indigenous peoples so that they can fully participate in the monitoring and other mechanisms of UNESCO conventions and IFAD projects and programmes that are relevant to indigenous peoples. The Permanent Forum further recommends that UNESCO establish an advisory group of indigenous experts to provide advice.

The Permanent Forum has paid particular attention to the participation and representation of indigenous peoples in development processes, such as those related to the Millennium Development Goals, data collection and disaggregation, and urban indigenous peoples and migration. The Forum has recommended on numerous occasions that United Nations agencies, international financial institutions and other development actors change their paradigms and approaches to their work with indigenous peoples. This includes increased mainstreaming of indigenous peoples’ issues in their work, respect for the principle of free, prior and informed consent, recognition of collective rights, including treaty rights, and increased participation of indigenous peoples, including women, in programme design, implementation and monitoring.

Recognizing the deep spiritual relationship indigenous peoples have with water, and the great respect they have for the natural laws governing the health and the sanctity of water, the Permanent Forum recommends that States review, with the direct participation of indigenous peoples, their laws on water regulation and the treaties, land claims and self-government agreements that they have entered into with indigenous peoples, taking into account the sanctity of water reflected in those agreements. It is further recommended that States present their reviews to the eighth session of the Permanent Forum in 2009, including in particular, information on the status of the implementation of laws and agreements with respect to water and indigenous peoples.

The Forum anticipates that the host country will do its utmost to assure the issuance in a timely manner of entry visas to members of the Forum and observers from non-governmental organizations, pursuant to article IV, section 11, of the Headquarters Agreement, in order to attend its sessions. The Forum also anticipates that other member States hosting United Nations meetings to which indigenous organizations are invited will also do their utmost to ensure the timely issuance of entry visas. The Forum further requests that consideration be given to the waivering of visa fees by host countries for applicants wishing to participate in the work of the Forum and related meetings and activities.

The Permanent Forum is concerned about reports of UNDP entering into a strategic partnership with the oil company GeoPark, a private entity that has been accused by indigenous communities of disregarding their rights, to carry out economic development activities in Colombia without the free, prior and informed consent of the indigenous communities that will be affected. This partnership contradicts standard 6 (indigenous peoples) of the UNDP social and environmental standards, and the Forum urges UNDP to suspend all related partnership activities until a proper free, prior and informed consent process can be carried out.

The Permanent Forum welcomes the adoption of resolution 63/278, by which the General Assembly established International Mother Earth Day and embraces indigenous peoples’ and Member States’ recommendations regarding the need to promote humankind living in harmony with nature. Therefore, the Forum decides to appoint Mr Carlos Mamani Candori and Mr Bartolome Clavero, members of the Forum as Special Rapporteurs, to conduct a study, without financial implications, on its implementation, taking into account, inter alia, the consideration and recognition of Mother Earth rights and submit a report to the ninth session of the Forum in 2010.

States should recognize indigenous peoples’ rights to forests and should review and amend laws that are not consistent with the United Nations Declaration on the Rights of Indigenous Peoples and other international standards on indigenous peoples’ land and natural resource rights, including over forests. This includes indigenous peoples’ customary law on land and resource rights and the right to be fully involved in decision-making processes.

The Permanent Forum notes the progress achieved by the Regional Bureau for Latin America and the Caribbean of the United Nations Development Programme (UNDP) in the implementation of a programme on electoral processes with a focus on indigenous women and youth. However, the Permanent Forum is concerned about the Regional Initiative on Indigenous Peoples’ Rights and Development in Asia and the Pacific, a programme that has critically contributed to promoting indigenous peoples’ issues and rights in the region. The Permanent Forum urges UNDP to maintain and strengthen this important programme.

The Forum recommends the establishment of an international ethical code on bio-prospecting in order to avoid bio-piracy and ensure the respect for indigenous cultural and intellectual heritage. Under the framework of the Convention, a mechanism should be established for the repatriation and devolution of genetic materials collections to indigenous peoples. The Forum recommends to the Convention secretariat that the global taxonomy initiative incorporate an ethical principles and social framework for the protection of indigenous peoples’ rights to their lands, traditional knowledge and resources before its implementation.
