During the pandemic, indigenous peoples have been seriously affected by a lack of access to energy, health-care establishments, education centres, infrastructure that supplies clean water, and communication services and information technologies. Governments have made a range of efforts to support economic activity in their responses to the economic impacts of the pandemic. The relaxation of environmental and human rights standards in order to support activities that will promote economic growth, such as logging, mining, large-scale agriculture and various infrastructure and energy projects, threaten indigenous peoples’ territories. The Permanent Forum requests Member States to include indigenous peoples in the preparatory process and the outcome of the high-level dialogue on energy to be held by the General Assembly in September 2021, in order to accelerate action on achieving Goal 7 and the implementation of the 2030 Agenda and the Paris Agreement.

In “a spirit of partnership and mutual respect”, the Permanent Forum emphasizes the important standards set out in articles 18, 19 and 41 of the Declaration. Article 18 provides that “indigenous peoples have the right to participate in decision-making in matters that would affect their rights, through representatives chosen by themselves in accordance with their own procedures”, and article 19 provides that “States shall consult and cooperate in good faith with the indigenous peoples concerned through their own representative institutions in order to obtain their free, prior and informed consent before adopting and implementing legislative or administrative measures that may affect them”. Such equal, direct and meaningful participation by indigenous peoples throughout all stages of the World Conference is essential for the international community to achieve a constructive and comprehensive outcome that will genuinely improve the status and conditions of indigenous peoples worldwide.

The Forum encourages the World Intellectual Property Organization (WIPO) and its Member States to take practical steps to ensure that the inappropriate and unauthorized documentation and publication of traditional knowledge and traditional cultural expressions/folklore does not occur, and to reinforce the capacity of indigenous peoples and local communities to make informed decisions in their own interests concerning whether and how documentation should be issued, including through the development of practical toolkits and guides which should have this as their aim.

The Permanent Forum recalls General Assembly resolution 66/296 and recommends that the President of the sixty-eighth session of the Assembly organize an informal interactive hearing, back-to-back with, but separate from, the thirteenth session of the Forum. This will ensure that those representatives of indigenous peoples who are attending the Forum are also able to participate in the informal interactive hearing without the need to return to New York at a later date and incur further travel and other related expenditures.

The Permanent Forum recalls that, more than 10 years ago, the International Fund for Agricultural Development established an indigenous forum, which the Forum has repeatedly recognized as a good practice and recommended that other United Nations entities should follow. However, despite these recommendations, other entities have not done so, with the notable exception of the Local Communities and Indigenous Peoples Platform of the United Nations Framework Convention on Climate Change. The Forum reiterates its recommendation that United Nations entities should incorporate indigenous-driven platforms in order to give advice on and promote indigenous peoples’ issues and should consider the participation of the Permanent Forum together with indigenous peoples in such platforms.

The Permanent Forum recommends that Member States formulate evidence- based policies, long-term strategies and regulatory frameworks, in cooperation with indigenous peoples, to ensure their support and the protection and revitalization of indigenous languages, including adequate, sustained support for bilingual, mother- tongue education. The Forum also recommends that States facilitate the mainstreaming of indigenous languages. Allowing indigenous peoples to gain access to health care and other public services in their own languages will help to ensure their overall well-being.

The Permanent Forum notes the importance of several concurrent United Nations Decades that are of importance to indigenous peoples. The Permanent Forum recommends that the United Nations entities responsible for the international decades declared by the General Assembly, such as the United Nations Decade on Ecosystem Restoration, the United Nations Decade of Ocean Science for Sustainable Development, the International Decade for Action, “Water for Sustainable Development”, 2018–2028, and the International Decade of Indigenous Languages, ensure good communication and coordinate efforts regarding the participation of indigenous peoples and their issues. In this regard, the Permanent Forum recommends that the relevant United Nations entities report to the Department of Economic and Social Affairs, which, in turn, is invited to prepare a study on the funding, modalities and scale of indigenous peoples’ participation in all four Decades. The Permanent Forum further invites Member States to support and fund cooperation during the four Decades to ensure the full and effective participation of indigenous peoples.

The round tables, workshops, hearings and preparatory conferences should focus on action-oriented outcomes based on inclusive and participatory processes, to be accorded official status. A drafting committee could be appointed by the President of the General Assembly for that purpose, in consultation with Member States and indigenous peoples.
