Positive developments have been achieved in setting international human rights standards for the rights of indigenous peoples to lands, territories and resources, including by regional human rights mechanisms in Africa and the Americas. The Permanent Forum welcomes those developments, including the recent decision of the African Court on Human and Peoples’ Rights in the case of the Ogiek community in Kenya. The Forum encourages indigenous peoples and States to engage further with regional mechanisms and to implement their decisions effectively.

The Permanent Forum expresses concern that indigenous peoples are not receiving adequate information regarding the achievement of the Sustainable Development Goals at the national level and encourages Governments, United Nations entities, indigenous peoples and civil society organizations to convene workshops and other forums to ensure their effective participation in implementing the 2030 Agenda.

The Permanent Forum expresses concern regarding indigenous young people in situations in which they are increasingly migrating from their communities because of poverty, lack of economic opportunities and climate change. With a focus on Sustainable Development Goal 8, the Forum encourages ILO and IOM, in cooperation with indigenous peoples, to conduct a study, by 2021, on good practices on, opportunities for and challenges in generating culturally appropriate, decent work for indigenous young people. The study should inform the development of programmes and initiatives for indigenous youth employment, both in their communities and in the context of migration.

The Permanent Forum underscores that direct access to financing for Indigenous Peoples is essential and requires changing strategies and methodologies to effectively enable the agency of Indigenous Peoples in pursuing their own development aspirations and as guardians of ecosystems. The Permanent Forum recommends that all donors increase direct funding, eliminating intermediaries where possible. To enhance accountability in financing for Indigenous Peoples, the Permanent Forum recommends that the Development Aid Committee of the Organisation for Economic Co-operation and Development include a policy marker in its statistical system for the reporting of development aid to facilitate tracking of funding allocated for Indigenous Peoples across all sectors.

The Permanent Forum recommends that the Economic and Social Council and the General Assembly ensure the meaningful participation of indigenous peoples and the Forum at the meetings of the 2019 high-level political forum on sustainable development, to be convened under the auspices of the Council and the Assembly in July and September 2019, respectively. The Forum stresses that the contributions of indigenous peoples to the implementation of the 2030 Agenda should be adequately reflected in the outcome document of the high-level political forums convened under the auspices of the Council and of the Assembly.

The Permanent Forum welcomes the growing interest in participation in the Forum’s sessions among Africa’s indigenous peoples’ representatives, States, the Working Group on Indigenous Populations/Communities in Africa of the African Commission on Human and Peoples’ Rights, United Nations agencies, funds and programmes, and academic institutions working in Africa. The Forum requests that the United Nations system and other donors scale up their support for the participation of indigenous peoples of Africa in the Forum’s annual sessions.

The Permanent Forum expresses appreciation for Nepal being the only Asian country to ratify the Indigenous and Tribal Peoples Convention, 1989 (No. 169), in 2007. Nevertheless, it is concerning that, even 10 years after ratification, the Government has not adopted a national action plan to implement the Convention. The Forum recommends that Nepal immediately adopt a national action plan, including in line with its commitment in the outcome document of the World Conference on Indigenous Peoples. The Forum urges other Asian States to consider ratifying the Convention as per the recommendations made by treaty bodies and in the universal periodic review.

The Permanent Forum recommends that United Nations entities, including the Inter-Agency Support Group on Indigenous Peoples’ Issues, take effective measures to support the promotion of indigenous languages and the successful implementation of the goals and objectives of the International Year, including in activities related to the implementation of the 2030 Agenda for Sustainable Development, the systemwide action plan on the rights of indigenous peoples, the celebration of international days and other processes.

The Permanent Forum reiterates its recommendation to adopt a programme of work on article 8 (j) and other provisions of the Convention on Biological Diversity and strengthened institutional arrangements through a permanent subsidiary body to take forward the Kunming-Montreal Global Biodiversity Framework and to ensure a human rights-based approach, and full and effective participation of Indigenous Peoples, by the sixteenth meeting of the Conference of the Parties to the Convention. The Permanent Forum recommends ensuring direct access to financial resources for Indigenous Peoples, inclusive of all landscapes and seascapes, more efficient financial mechanisms managed by Indigenous Peoples and the inclusion of Indigenous Peoples’ representatives in the governance of the Framework to better design and implement grants. The Permanent Forum urges Member States to consider the expansion of the mandate of the United Nations Voluntary Fund for Indigenous Peoples to support grantees who have effective initiatives to implement recommendations of United Nations human rights mechanisms; the participation of indigenous peoples in the Forum on Business and Human Rights; and the participation of indigenous peoples in the pre-sessions of the Working Group on the Universal Periodic Review of the Human Rights Council.

The Permanent Forum commends States for recognizing the collective rights of indigenous peoples to lands, territories and resources and at the same time urges them to take immediate steps for the implementation of those rights through programmes for mapping, titling or other actions and legislative reforms. The Forum urges States to report to it by its twentieth session on steps taken in that regard.
