The Permanent Forum requests the secretariat of the Convention on Biological Diversity to complete its work on the draft code of ethical conduct for the recognition and protection of indigenous intellectual property and cultural heritage, taking into account the United Nations Declaration on the Rights of Indigenous Peoples, as a minimum standard, with a view to adopting the code at the tenth meeting of the Conference of the Parties in 2010, the International Year of Biodiversity.eas.

The Permanent Forum applauds the good work of the nomadic herders project on enhancing the resilience of pastoral ecosystems and livelihoods, led by the United Nations Environment Programme (UNEP)/GRID-Arendal and the Association of World Reindeer Herders. The Permanent Forum recommends that the Global Environment Facility Council approve the project as a good example of a transboundary project by and for indigenous peoples.

Alarmed at attempts to exclude indigenous peoples of Africa in the application of World Bank Operational Policy 4.10, the Permanent Forum recommends that the World Bank immediately initiate consultations with States and indigenous peoples in Africa as part of its safeguards policy review and ensure the application of safeguards to indigenous peoples of Africa, as directed by articles 19 and 41 of the Declaration.

The Permanent Forum welcomes the measures undertaken by several countries that aim, inter alia, to explore and develop alternative sources of income, significantly reduce the exploitation of natural resources, enhance conservation of biological diversity and establish measures in favour of indigenous peoples in voluntary isolation, such as the national initiative undertaken by Ecuador entitled “Yasuni-ITT initiative”. The Permanent Forum recommends that such measures respect the right to free, prior and informed consent of the indigenous peoples concerned.

The Permanent Forum urges States to review their policies on biofuel industries, which, in the name of remedying the impacts of climate change, are resulting in the deforestation of large forest areas and the displacement of indigenous peoples. The Permanent Forum is concerned about reports of UNDP entering into a strategic partnership with the oil company GeoPark, a private entity that has been accused by indigenous communities of disregarding their rights, to carry out economic development activities in Colombia without the free, prior and informed consent of the indigenous communities that will be affected. This partnership contradicts standard 6 (indigenous peoples) of the UNDP social and environmental standards, and the Forum urges UNDP to suspend all related partnership activities until a proper free, prior and informed consent process can be carried out.

Recognizing the emerging role of civil society and indigenous peoples in the search for creative solutions as a means of contributing to formulating, developing and implementing policies and programmes of the United Nations system, the Forum welcomes the initiative of the Secretary-General to create a high-level panel to prepare a series of recommendations on the participation of civil society in the work of the United Nations system. The Forum recommends that the Secretary-General ask the high-level panel to hold consultations and to take into account the recommendations of the Forum on the improvement of indigenous peoples’ participation in and contributions to the work of the United Nations system.

The Permanent Forum is concerned about the growing impacts of climate change and environmental degradation on the lives and livelihoods of indigenous peoples around the world. The Forum recommends that the International Organization for Migration and other relevant organizations provide technical cooperation and operational assistance to those Governments and communities planning organized migration management solutions for climate change and environmental refugees and migrants, giving priority, according to the principle of free, prior and informed consent, to the assisted voluntary resettlement and reintegration of those indigenous communities whose territories are no longer inhabitable.
