The Forum expresses its great concern about the effects of armed conflict on indigenous women and children, and recommends that a workshop be convened with the framework of the 10-year review of the Beijing Declaration and Platform for Action in order to formulate strategies to protect vulnerable groups, such as indigenous peoples, especially taking into account the vulnerabilities of indigenous women and children. These strategies should incorporate capacity-building of indigenous women living in areas of armed conflict or in precarious circumstances.

The Permanent Forum recommends that the Organization of American States establish a consultation mechanism, composed of experts from indigenous peoples, as part of the effort to ensure national implementation of the American Declaration on the Rights of Indigenous Peoples, the United Nations Declaration on the Rights of Indigenous Peoples and the Indigenous and Tribal Peoples Convention, 1989 (No. 169).

The Permanent Forum also welcomes the recent adoption of the United Nations Development Group guidelines for indigenous peoples’ issues, which will bring the United Nations normative framework on indigenous peoples to the field level and contribute to the implementation of the goals and objectives of the Decade and of the United Nations Declaration on the Rights of Indigenous Peoples. The Forum encourages the United Nations system to support the Guidelines with a programme of action and calls upon the donor community to provide resources to that effect. The Forum also calls upon the Inter-Agency Support Group on Indigenous Issues to review and revise the Guidelines in light of the adoption of the Declaration.

The Permanent Forum welcomes the legal reforms and policies carried out in some States to recognize the right of indigenous peoples to food and food sovereignty. It would also like to encourage the remaining States to take the steps towards its recognition. The Permanent Forum encourages States to take positive actions to facilitate the capacity of indigenous peoples to strengthen traditional food systems, such as formally recognizing and demarcating indigenous territories to enable them to carry out productive food activities, in accordance with article
8 (2) (b) of the Declaration, which prohibits States from any action that has the aim or effect of dispossessing indigenous peoples of their lands, territories or resources.

The Permanent Forum regrets the continuous killings, violence and harassment targeted at indigenous human rights defenders, including indigenous women, in the context of resisting mining and infrastructure projects and other such developments. The Permanent Forum therefore invites Member States to honour their human rights obligations. In this regard, the Permanent Forum welcomes General Assembly resolution 76/148 on the rights of indigenous peoples, in which States are urged to take necessary measures to ensure the rights, protection and safety of indigenous peoples, including indigenous leaders and indigenous human rights defenders, and to ensure that perpetrators are held accountable and that access to justice and remedy is guaranteed.

The Permanent Forum hails the adoption of the United Nations Declaration on the Rights of Indigenous Peoples by the General Assembly. The 13th of September 2007 is a historic day for the United Nations, indigenous peoples and States and marks the beginning of a new era of renewed partnerships for the promotion and protection of the human rights of all indigenous peoples and each indigenous person around the world. The Forum notes its new responsibility under the Declaration and pledges its commitment to making it a living document throughout its work. The Forum thus invites the international community as a whole, States, indigenous peoples, non-governmental organizations, the private sector, academia and the media to promote the Declaration and apply it in their policies and programmes for the improvement of indigenous peoples’ well-being around the world

The Permanent Forum welcomes the decision 2009/250 of the Economic and Social Council on a proposed amendment to the Single Convention on Narcotic Drugs of 1961 as amended by the 1972 Protocol, related to the traditional use of the coca leaf. The Forum recommends that Member States support this initiative, taking into account articles 11, 24 and 31 of the United Nations Declaration on the Rights of Indigenous Peoples.

The Permanent Forum urges States to prepare reports on the actions taken to address the recommendations of all United Nations special rapporteurs, in particular the Special Rapporteur on the rights of indigenous peoples, especially the recommendations made at the conclusion of country visits, and encourages States to monitor their progress in this regard, in collaboration with indigenous peoples, United Nations country teams and all other relevant parties. Furthermore, the Forum reiterates that national human rights institutions are encouraged to assist indigenous peoples, the Special Rapporteur on the rights of indigenous peoples and the Permanent Forum in the implementation of the Declaration.

The Forum urges Governments, in addressing economic and social development issues, to make efforts to adopt general strategies that include considerations for the needs and rights of indigenous peoples in the policies, laws and administrative issues that affect them, and they should include participation and consultations with indigenous peoples. Governments should also consider implementing special policies directed to employment creation for indigenous peoples, facilitating access to credit and the creation of small and medium-sized businesses.

The Permanent Forum invites the Working Group on the use of mercenaries as a means of violating human rights and impeding the exercise of the right of peoples to self-determination to conduct a study on the human rights abuses against Indigenous Peoples of the Sahel region by mercenaries and other non-State armed actors.
