The Forum recommends that a world conference on indigenous peoples in the information society be organized on the occasion of the World Summit on the Information Society (10-12 December 2003), in close cooperation with interested Governments and NGOs. It is recommended that the assistance of the secretariat of the Summit be provided for the organization of such an event. The Forum recommends that a written report on indigenous peoples in the information society be addressed by the focal point of the Forum, Mr. Matias, to the preparatory committee for the Summit before 31 August 2003.

The Permanent Forum notes that the Constitutional Court of Guatemala issued ruling No. 2112-2016 of 24 October 2017 on indigenous peoples’ intellectual collective property. The Permanent Forum urges Guatemala to comply with the ruling and to adopt laws and policies, respecting the free, prior and informed consent of indigenous peoples.

The Permanent Forum welcomes the initiation of a national dialogue to discuss and achieve key constitutional reforms in the field of justice in Guatemala, and encourages the recognition of indigenous justice systems. The Forum urges Guatemala and the private sector, in addition to the World Bank and other international economic institutions, to acknowledge that serious efforts require structural economic and social reforms rather than rapid growth of gross domestic product in order to reverse widespread and growing poverty among the indigenous peoples of Guatemala. Such crucial reforms must ensure more equitable distribution and access to traditional lands for the indigenous peoples of Guatemala, consistent with the rights affirmed in the United Nations Declaration, and on the basis of respect for and legal recognition of their collective rights, including their self-determined development. Furthermore, the Forum calls upon Guatemala to reinforce the effective and full implementation of the Peace Accords.

The Forum endorses the report and recommendations of the three-day international expert group meeting on the theme “Combating violence against indigenous women and girls: article 22 of the United Nations Declaration on the Rights of Indigenous Peoples” (E/C.19/2012/6). The Forum requests that the report form part of the official documentation of the Commission on the Status of Women at its fifty-seventh session, to be held in 2013.

The Permanent Forum encourages FAO and other relevant agencies to favour and promote in member countries the acknowledgement and improvement of land tenure legal frameworks to recognize indigenous peoples’ land rights. The Forum recommends that FAO and other relevant United Nations agencies support activities for participatory delimitation and titling where the legal framework recognizes indigenous land rights. FAO should pay special attention to indigenous peoples’ customary laws regarding land.

The Permanent Forum recommends that agencies, funds and programmes of the United Nations system, in collaboration with indigenous peoples ’ organizations, monitor the high levels of global violence and threats directed at indigenous women human rights defenders. The Forum calls for an immediate halt to the criminalization,
incarceration, intimidation, coercion and assassination of, and death threats to, all indigenous human and environmental rights defenders.

The Permanent Forum once again reiterates its concern that reports developed and presented by many States on the implementation of the Millennium Development Goals and poverty reduction strategy papers still do not adequately include and address indigenous peoples, nor do they include their participation, and it therefore calls on States to rectify this situation and on United Nations agencies to support their efforts. Furthermore, the Forum encourages the United Nations Development Programme (UNDP) to integrate indigenous peoples’ issues into the global, regional, national and local human development reports, and in particular to include indigenous experts in preparing those reports and to guarantee that indigenous peoples’ issues are mainstreamed in them.

The Permanent Forum calls upon the World Bank to include the rights of indigenous peoples in its knowledge and learning activities for staff and management. Instruments for learning, such as the Nordic Trust Fund, should include training on how operational policies in place regarding the rights of indigenous peoples should be fully implemented.
