The Permanent Forum recommends that United Nations organizations provide technical assistance and convene, in cooperation with indigenous peoples’ organizations, regional workshops on the special theme of the sixth session of the Permanent Forum, namely, “Territories, lands and natural resources”, with the participation of Permanent Forum members, and other experts, indigenous peoples’ representatives, indigenous parliamentarians, State representatives, and representatives of the United Nations system, in order to formulate recommendations for consideration, as part of its preparatory work for the sixth session. The Permanent Forum further recommends that States, organizations and donors provide resources for these regional workshops.

The Permanent Forum recommends that WHO create and convene regional round tables to address the issue of indigenous peoples and the pandemic in order to ensure that the indigenous peoples of the globe are uniquely considered in mitigation efforts. Such round tables would also offer a timely opportunity to coordinate actions for responding to the impact of the pandemic on indigenous peoples.

In the light of the study by Ms. Toki on the relationship between indigenous peoples and the Pacific Ocean and the dire effects of climate change, such as forced relocation and the loss of culture and livelihood, on vulnerable small island Pacific States, the Permanent Forum recommends that United Nations entities, including UN-Oceans, the United Nations Framework Convention on Climate Change and UNESCO, in addition to the International Seabed Authority, comply with and implement the relevant articles of the United Nations Declaration (arts. 18, 27 and 32), so as to ensure the full and effective participation of indigenous peoples. This should include meaningful participation, such as dedicated indigenous representation within each of these United Nations entities, and regard for indigenous peoples’ world views.

The Permanent Forum welcomes the decision by the African Commission on Human and Peoples’ Rights to promote and protect the rights of non-dominant minorities in Africa, who are distinct from indigenous populations and/or communities. While recognizing the importance of the rights of persons belonging to minorities, the Permanent Forum is concerned that the expanded mandate could compromise the current Commission standards for promoting the rights of indigenous peoples. The Permanent Forum therefore urges the Commission to establish a separate working group on minority rights. The Permanent Forum calls on the Commission to work closely with it, indigenous peoples representatives from Africa, and United Nations entities to highlight and advance the recognition, rights and participation of indigenous peoples at the regional and national levels. The Forum recommends that the United Nations Framework Convention on Climate Change consider the possible establishment of an ad hoc open-ended intersessional working group on indigenous peoples and local communities and climate change, whose objectives would be to study and propose timely, effective and adequate solutions to respond to the urgent situations caused by climate change that indigenous peoples and local communities face. The Forum furthermore recommends that the Convention consider providing necessary funding support to Forum members and indigenous peoples to guarantee their participation and to strengthen their participation.

The Permanent Forum recommends that the President of the General Assembly take immediate steps to ensure the full, equal, direct and effective participation of indigenous peoples throughout all aspects and processes of the high-level plenary meeting/World Conference on Indigenous Peoples in order to achieve an action-oriented, concise, inclusive, constructive and comprehensive outcome that will genuinely promote the full and effective implementation of the United Nations Declaration on the Rights of Indigenous Peoples (art. 18).

The Permanent Forum is concerned by the high number of indigenous children being removed from their families and placed into public social care, in particular in developed countries. In this regard, the Forum noted with satisfaction the Expert Mechanism’s engagement on the rights of the indigenous children. The report of the Expert Mechanism on the indigenous child will be discussed at its forthcoming session, in July 2021.

In “a spirit of partnership and mutual respect”, the Permanent Forum emphasizes the important standards set out in articles 18, 19 and 41 of the Declaration. Article 18 provides that “indigenous peoples have the right to participate in decision-making in matters that would affect their rights, through representatives chosen by themselves in accordance with their own procedures”, and article 19 provides that “States shall consult and cooperate in good faith with the indigenous peoples concerned through their own representative institutions in order to obtain their free, prior and informed consent before adopting and implementing legislative or administrative measures that may affect them”. Such equal, direct and meaningful participation by indigenous peoples throughout all stages of the World Conference is essential for the international community to achieve a constructive and comprehensive outcome that will genuinely improve the status and conditions of indigenous peoples worldwide.
