The Forum anticipates that the host country will do its utmost to assure the issuance in a timely manner of entry visas to members of the Forum and observers from non-governmental organizations, pursuant to article IV, section 11, of the Headquarters Agreement, in order to attend its sessions. The Forum also anticipates that other member States hosting United Nations meetings to which indigenous organizations are invited will also do their utmost to ensure the timely issuance of entry visas. The Forum further requests that consideration be given to the waivering of visa fees by host countries for applicants wishing to participate in the work of the Forum and related meetings and activities.

The Permanent Forum recommends that United Nations agencies review their policies, which presently allow them to assist only indigenous peoples in developing countries, and to urgently revise such policies to ensure that all indigenous peoples, in both developed and developing countries, have access to resources, technical assistance and other support from all United Nations agencies and funds.

Indigenous peoples have been a distinct constituency at the United Nations since 1977 and, with the adoption of the United Nations Declaration on the Rights of Indigenous Peoples by the General Assembly in 2007, their inherent rights were affirmed as the international minimum standard. The Permanent Forum reiterates the position of the Special Rapporteur on the rights of indigenous peoples, namely that it is unacceptable to undermine the status and standing of indigenous peoples by combining or equating them with non-indigenous entities such as minorities, vulnerable groups or local communities. Such attempts, whether by States or United Nations entities, are not acceptable and will be challenged by indigenous peoples and those mandated to defend their rights. The Permanent Forum urges all United Nations entities and States parties to treaties concerning the environment, biodiversity and the climate to eliminate the use of the term “local communities” in conjunction with indigenous peoples, so that the term “indigenous peoples and local communities” would be abolished.

The Permanent Forum expresses its concern about the continuing and long-term negative impacts of large dams on indigenous peoples in many parts of the world. Many large dams continue to be planned for construction on indigenous lands. The Permanent Forum supports the implementation of the recommendations of the World Commission on Dams contained in its report Dams and Development: A New Framework for Decision-making. The implementation of these recommendations must be in accordance with the provisions set out in the United Nations Declaration on the Rights of Indigenous Peoples.

The Forum notes that in order for it and the United Nations system to review the situation of indigenous children and youth, there is a need for country-specific situation analyses. Given UNICEF’s unique and long experience and expertise in that area, the Forum invites UNICEF to initiate such situation analyses on indigenous children by field offices in countries with indigenous communities. The Forum also invites UNICEF to transmit such situation analyses to the Forum.

The Permanent Forum was presented with horrific testimonies of Indigenous children incarcerated in prisons and other holding facilities. The Permanent Forum reminds Member States to fulfil their obligations under the Convention on the Rights of the Child in relation to the arrest, detention, or imprisonment of a child. No child should be in prison. In that regard, the Permanent Forum notes the finding in 2022 of the Supreme Court of Western Australia that the extensive solitary confinement and significant reduction in liberty of children, primarily Aboriginal children, was unlawful. The Permanent Forum calls upon Australia to respect the Court decision and remove its reservation to article 37 of the Convention on the Rights of the Child. The Permanent Forum recommends that Member States review and reform their child protection policies and systems to prevent undue removal of Indigenous children from their families and communities.

The Permanent Forum recognizes that the United Nations has declared 2010 the International Year of Biodiversity and that indigenous peoples, as custodians of the Earth’s biodiversity, should be major players in actions planned for 2010. In that spirit, the Permanent Forum calls for close cooperation between the secretariat of the Convention on Biological Diversity and the Forum in promoting the International Year and in highlighting the role of indigenous peoples as custodians of biodiversity.

The Permanent Forum requests that its secretariat prepare a report on the implementation of the recommendations made, to be submitted to the Forum at its eleventh session, in 2012. The report should analyse the challenges as well as the associated factors that United Nations agencies and funds, Member States and indigenous peoples’ organizations have faced.
