For the post-2015 dialogue and outcomes to accomplish a sea change and paradigm shift away from a North-South dialogue to one of universally addressing the post-2015 objectives in order to improve the lives of all, including indigenous peoples in developed countries, the Forum recommends that efforts must be made to guarantee the direct participation of indigenous peoples from the world’s most developed and affluent countries in all thematic consultations, conclusions and recommendations so that their voices and concerns can be heard.

The Permanent Forum also recommends that WHO and the Pan American Health Organization (PAHO) engage in an intersessional round table on the pandemic with Forum members to ensure that ongoing mitigation planning and efforts are uniquely adapted to the needs of indigenous peoples, including by applying intercultural approaches to health, such as those applied by PAHO in the Americas.

The Permanent Forum recalls the many recommendations that call for statistics on indigenous health. Data collection and disaggregation remain a challenge. In particular, the delivery of health care in rural and remote areas remains a major obstacle to the right to health. In addition, there remains an urgent need for more indigenous health professionals, mental health services and programmes addressing non-communicable diseases and reproductive health. In particular, the Forum reaffirms the recommendation of the eighth session that an expert group meeting on sexual health and reproductive rights be held.

The Permanent Forum recommends that the United Nations Population Fund (UNFPA) advance data and research on the challenges that indigenous women and girls face in realizing their right to bodily autonomy and the right to be free from violence, including reproductive coercion and in birthing practices. Furthermore, the Permanent Forum invites UNFPA to prepare a study on indigenous women’s bodily autonomy, with the participation of indigenous women, and to present its findings at the twenty-third session of the Permanent Forum, to be held in 2024.

The Permanent Forum recognizes the need to address the emergence of the mental health consequences of the pandemic. The consequences are being felt in all populations, but most acutely in populations that have traditionally been marginalized. The Forum calls for investments and preparations for mental and behavioural health interventions that are culturally adapted. Traditional medicines and practices can play a key role in the health of indigenous communities and individuals by encompassing a variety of dimensions, including the spiritual. The Forum calls on WHO, PAHO, States Members of the United Nations and indigenous peoples to work together to provide pathways for promoting mental health.

Considering that indigenous peoples are empowered to assume leadership in governments at various levels, particularly at the local level, the Permanent Forum urges the United Nations system, including the Department of Economic and Social Affairs, UNDP and all other relevant agencies, with the support of Member States and donor agencies, to implement, before the convening of its next session, a platform for indigenous local-local cooperation and the establishment of a network of indigenous local governments for information exchange and capacity-building on public administration, local socio-economic governance and participatory approaches to facilitate the implementation of the goals of the United Nations Millennium Declaration and the United Nations development agenda at the local level among indigenous peoples in all regions.

Considering their impact on the sexual health and reproductive rights of indigenous peoples, the Permanent Forum calls, in paragraph 62 of the report, for “a legal review of United Nations chemical conventions, in particular the Rotterdam Convention, to ensure that they are in conformity with international human rights standards, including the United Nations Declaration on the Rights of Indigenous Peoples and the Convention on the Rights of Persons with Disabilities”.

The Permanent Forum has paid particular attention to the participation and representation of indigenous peoples in development processes, such as those related to the Millennium Development Goals, data collection and disaggregation, and urban indigenous peoples and migration. The Forum has recommended on numerous occasions that United Nations agencies, international financial institutions and other development actors change their paradigms and approaches to their work with indigenous peoples. This includes increased mainstreaming of indigenous peoples’ issues in their work, respect for the principle of free, prior and informed consent, recognition of collective rights, including treaty rights, and increased participation of indigenous peoples, including women, in programme design, implementation and monitoring.

The Permanent Forum welcomes the recent entry into force of the Optional Protocol to the International Covenant on Economic, Social and Cultural Rights. The Forum encourages Member States to accede to the Optional Protocol and requests the Committee on Economic, Social and Cultural Rights to consider the preparation of a general comment on the economic, social and cultural rights of indigenous peoples.
