The Permanent Forum welcomes the decision by the African Commission on Human and Peoples’ Rights to promote and protect the rights of non-dominant minorities in Africa, who are distinct from indigenous populations and/or communities. While recognizing the importance of the rights of persons belonging to minorities, the Permanent Forum is concerned that the expanded mandate could compromise the current Commission standards for promoting the rights of indigenous peoples. The Permanent Forum therefore urges the Commission to establish a separate working group on minority rights. The Permanent Forum calls on the Commission to work closely with it, indigenous peoples representatives from Africa, and United Nations entities to highlight and advance the recognition, rights and participation of indigenous peoples at the regional and national levels. The Permanent Forum welcomes the efforts of the indigenous Global Coordinating Group to respond to the request of the President of the General Assembly as its sixty-eighth session, which concluded with the nomination of two indigenous advisers. The Forum urges the President of the sixty-eighth session to formalize their designation so as to start the consultation process on the high-level plenary meeting/World Conference on Indigenous Peoples as soon as possible, by June.

The Forum expresses its satisfaction that the Inter-Agency Support Group has met since the first session of the Forum to organize its input to the second session, and expresses appreciation to the ILO and the World Bank for having convened the Group. The Forum requests the Group to extend its membership to other United Nations system entities so as to promote the largest possible participation of the system in the work programme of the Forum, and requests the secretariat of the Forum to provide substantive support to the rotating Chair of the Group. The Forum also expresses appreciation for the active participation of agency focal points in a constructive dialogue during its second session, and expresses the hope that focal points will continue to participate at its third session.

The Permanent Forum welcomes the fact that the International Union for Conservation of Nature, in cooperation with indigenous peoples, is undertaking preparations for the World Summit of Indigenous Peoples and Nature to be convened during the upcoming World Conservation Congress, which will be held in Marseille, France, in September 2021. The summit is aimed at providing an opportunity to highlight and exchange information about the contributions of indigenous peoples to sustaining biodiversity, combating climate change and promoting sustainable development. The Forum recommends that Member States, international organizations and NGOs support the participation of indigenous peoples in the summit. The Forum invites the International Union for Conservation of Nature to share the outcomes of the summit at the Forum’s twenty-first session in 2022.

The Permanent Forum is concerned by the high number of indigenous children being removed from their families and placed into public social care, in particular in developed countries. In this regard, the Forum noted with satisfaction the Expert Mechanism’s engagement on the rights of the indigenous children. The report of the Expert Mechanism on the indigenous child will be discussed at its forthcoming session, in July 2021.

The Permanent Forum calls upon Member States to analyse the compatibility of domestic laws with the United Nations Declaration on the Rights of Indigenous Peoples, in particular with a view to harmonizing laws dealing with Arctic renewable resources upon which indigenous peoples depend, and to include the indigenous peoples of the Arctic in a direct and meaningful way in this analysis.

The Permanent Forum welcomes the work of the Government of Bangladesh with United Nations country offices to support peace in the Chittagong Hill Tracts. The Permanent Forum further welcomes the ongoing study on the status of implementation of the Chittagong Hill Tracts Peace Accord of 1997 and invites the Government of Bangladesh, with the full and effective participation of indigenous peoples, to report on the results of the study at the twenty-second session of the Permanent Forum, setting a timeframe for its full implementation. The Permanent Forum also calls upon the Government of Bangladesh to continue to address all forms of violence, including enforced disappearances, and sexual violence against women in the Chittagong Hill Tracts committed by law enforcement agencies.

The Permanent Forum is concerned that legal obligations and commitments and indigenous peoples’ treaties, agreements and other constructive arrangements with States are routinely denied and violated by States. With regard to interventions by indigenous peoples on unresolved land rights, including the Six Nations of the Grand River and others on which the Forum has made specific recommendations in the past, the Forum calls upon States to fairly and equitably redress the long-standing unresolved land rights issues through good-faith negotiations, consistent with the United Nations Declaration and without extinguishing indigenous peoples’ land rights.

The Forum recommends that the Conference of the Parties to the United Nations Framework Convention on Climate Change sponsor a workshop to discuss the merits and mechanisms for the establishment of a working group on indigenous peoples within the Conference of the Parties process, ensuring the participation of indigenous peoples from developed and undeveloped countries as well as interested member States.
