The Permanent Forum calls upon the Intergovernmental Committee to appoint representatives of indigenous peoples as members of any Friends of the Chair groups and as co-chairs of any working groups and drafting groups that may be established by the Committee. It also calls upon the Committee to appoint an indigenous person as a co-chair of the Committee as a whole.

The Permanent Forum welcomes the adoption of resolution 63/278, by which the General Assembly established International Mother Earth Day and embraces indigenous peoples’ and Member States’ recommendations regarding the need to promote humankind living in harmony with nature. Therefore, the Forum decides to appoint Mr Carlos Mamani Candori and Mr Bartolome Clavero, members of the Forum as Special Rapporteurs, to conduct a study, without financial implications, on its implementation, taking into account, inter alia, the consideration and recognition of Mother Earth rights and submit a report to the ninth session of the Forum in 2010.

The Permanent Forum recommends that United Nations organizations provide technical assistance and convene, in cooperation with indigenous peoples’ organizations, regional workshops on the special theme of the sixth session of the Permanent Forum, namely, “Territories, lands and natural resources”, with the participation of Permanent Forum members, and other experts, indigenous peoples’ representatives, indigenous parliamentarians, State representatives, and representatives of the United Nations system, in order to formulate recommendations for consideration, as part of its preparatory work for the sixth session. The Permanent Forum further recommends that States, organizations and donors provide resources for these regional workshops.

The Permanent Forum reiterates to the parties to the Convention on Biological Diversity, and especially to the parties to the Nagoya Protocol, the importance of respecting and protecting indigenous peoples’ rights to genetic resources consistent with the United Nations Declaration on the Rights of Indigenous Peoples. Consistent with the objective of “fair and equitable” benefit sharing in the Convention and Protocol, all rights based on customary use must be safeguarded and not only “established” rights. The Committee on the Elimination of Racial Discrimination has concluded that such kinds of distinctions would be discriminatory.

The Permanent Forum reiterates its concern about conservation efforts, including the designation of national parks, biosphere reserves and world heritage sites, which frequently lead to the displacement of indigenous peoples from their traditional lands and territories. In this regard, the Permanent Forum requests that a member of the Forum attend the thirty-fourth session of the UNESCO World Heritage Committee, to be held in Brasilia, Brazil, in August 2010.

The Permanent Forum encourages all States to endorse the Convention for the Safeguarding of the Intangible Cultural Heritage, considering the need to protect and enhance indigenous peoples’ distinct identities and cultural institutions, philosophies and world views, customary laws, indigenous political governance and justice systems, indigenous knowledge systems and sustainable traditional livelihoods and other economic systems, as well as to rebuild in urban centres the cultures and communities of indigenous peoples displaced from their traditional territories. The Forum calls upon States to build on good practices to ensure, safeguard and protect indigenous knowledge and intangible heritage and to promote indigenous peoples’ cultural expressions.

Recognizing the deep spiritual relationship indigenous peoples have with water, and the great respect they have for the natural laws governing the health and the sanctity of water, the Permanent Forum recommends that States review, with the direct participation of indigenous peoples, their laws on water regulation and the treaties, land claims and self-government agreements that they have entered into with indigenous peoples, taking into account the sanctity of water reflected in those agreements. It is further recommended that States present their reviews to the eighth session of the Permanent Forum in 2009, including in particular, information on the status of the implementation of laws and agreements with respect to water and indigenous peoples.

The Permanent Forum applauds the good work of the nomadic herders project on enhancing the resilience of pastoral ecosystems and livelihoods, led by the United Nations Environment Programme (UNEP)/GRID-Arendal and the Association of World Reindeer Herders. The Permanent Forum recommends that the Global Environment Facility Council approve the project as a good example of a transboundary project by and for indigenous peoples.

The Permanent Forum recommends that, prior to its seventh session, United Nations organizations should provide technical assistance and convene, in cooperation with indigenous peoples’ organizations, regional workshops on the special theme of the seventh session, “Climate change, bio-cultural diversity and livelihoods: the stewardship of indigenous peoples and new challenges”, with the participation of the members of the Forum and other experts, indigenous peoples’ representatives, indigenous parliamentarians, State representatives and representatives of the United Nations system, in order to formulate recommendations for consideration, as part of its preparatory work for the seventh session. The Permanent Forum further recommends that States, organizations and donors provide resources for these regional workshops and that the report on the human rights situation of indigenous peoples in States and Territories threatened with extinction for environmental reasons be included in the discussions held at the workshops.

States should recognize indigenous peoples’ rights to forests and should review and amend laws that are not consistent with the United Nations Declaration on the Rights of Indigenous Peoples and other international standards on indigenous peoples’ land and natural resource rights, including over forests.
