The Permanent Forum welcomes the adoption of resolution 63/278, by which the General Assembly established International Mother Earth Day and embraces indigenous peoples’ and Member States’ recommendations regarding the need to promote humankind living in harmony with nature. Therefore, the Forum decides to appoint Mr Carlos Mamani Candori and Mr Bartolome Clavero, members of the Forum as Special Rapporteurs, to conduct a study, without financial implications, on its implementation, taking into account, inter alia, the consideration and recognition of Mother Earth rights and submit a report to the ninth session of the Forum in 2010.

The Permanent Forum welcomes the dialogues to support indigenous peoples’ preparations for the United Nations Food Systems Summit. The Permanent Forum recommends that the Plurinational State of Bolivia should consider implementing the resolutions of the National Agrarian Reform Institute regarding the revocation of land titles on grounds of servitude in all matters affecting not only the freedom of individuals, but also the recovery of land for communities, thereby preventing legal proceedings from stalling a reform process that defends, promotes and protects human rights.

The Permanent Forum welcomes the reports of the Special Rapporteur of the Commission on Human Rights on the situation of human rights and fundamental freedoms of indigenous people, Rodolfo Stavenhagen, on the international seminars on “Constitutional Reforms, Legislation and Implementation of Laws regarding the Rights of Indigenous Peoples” held in Geneva and Tucson, Arizona, in July and October 2005, respectively (E/CN.4/2006/78/Add.5). Concerned about the status of recommendations and the implementation gap, the Permanent Forum recommends to indigenous peoples’ organizations, non-governmental organizations and interested United Nations organizations and States that they hold United Nations expert seminars regarding the implementation of the Special Rapporteur’s recommendations and request that the results of the meetings be reported to the Permanent Forum at its sixth session.
