The Permanent Forum recommends that States ensure that the territories of indigenous peoples in Asia be free of State military interventions and that military bases, camps and training centres established in indigenous territories without the free, prior and informed consent of indigenous peoples be removed immediately, consistent with articles 19 and 30 of the Declaration.

The Forum recommends that Governments conduct studies on how the diversion of rivers and creation of dams, mining and mineral extraction, energy development, the mining of groundwater and the use of aquifers for industrial and commercial purposes will affect the lives of indigenous communities prior to conducting any of these actions in order to ensure that indigenous peoples are not confronted with such problems as increasing scarcity of freshwater, the toxic contamination of indigenous peoples’ territories and the lack of access of indigenous communities and other life forms to water, including oceans.

The Permanent Forum welcomes the adoption by the Conference of the Parties to the Convention on Biological Diversity at its 10th meeting of the Code of Ethical Conduct to Ensure Respect for the Cultural and Intellectual Heritage of Indigenous and Local Communities Relevant to the Conservation and Sustainable Use of Biological Diversity (the Tkarihwaié:ri code of ethical conduct), which arose from a Forum recommendation made at its second session, and invites parties and Governments, international agencies and all those working with indigenous communities to make use of the code for research and access to, use, exchange and management of information concerning traditional knowledge.

The Permanent Forum reiterates its recommendation to adopt a programme of work on article 8 (j) and other provisions of the Convention on Biological Diversity and strengthened institutional arrangements through a permanent subsidiary body to take forward the Kunming-Montreal Global Biodiversity Framework and to ensure a human rights-based approach, and full and effective participation of Indigenous Peoples, by the sixteenth meeting of the Conference of the Parties to the Convention. The Permanent Forum recommends ensuring direct access to financial resources for Indigenous Peoples, inclusive of all landscapes and seascapes, more efficient financial mechanisms managed by Indigenous Peoples and the inclusion of Indigenous Peoples’ representatives in the governance of the Framework to better design and implement grants. Throughout history, indigenous peoples have moved from place to place to find water, pastureland for their animals, and game; to trade goods from different ecological zones; and even to seek job opportunities in urban areas. Mobility restrictions both within and across State borders have affected indigenous peoples adversely, with the impact on pastoralist groups particularly severe in the context of their ability to access water and food. The Permanent Forum recommends that States implement specific measures to address the mobility needs of indigenous peoples, including through cooperation with neighbouring States, and that such efforts be made with the full free, prior and informed consent of the indigenous peoples affected.

The Permanent Forum recognizes the importance of indigenous peoples knowledge systems as the basis of their development with culture and identity and therefore recommends that ongoing international processes, such as negotiations on the international regime on access and benefit-sharing of the Convention on Biological Diversity, the Ad Hoc Working Group on Long-term Cooperative Action of the United Nations Framework Convention on Climate Change, and the Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore of the World Intellectual Property Organization, should recognize and integrate the crucial role and relevance of indigenous knowledge systems in accordance with the United Nations Declaration on the Rights of Indigenous Peoples.

The Permanent Forum urges Member States to provide financial support to the trust fund on indigenous issues (fund 32FII) to support the work of the Forum in implementing its mandate and to the United Nations Voluntary Fund for Indigenous Peoples to facilitate the participation of indigenous peoples in key United Nations meetings and processes. The Forum recommends that States, private foundations, intergovernmental organizations and NGOs support the work of indigenous-led funding initiatives.
