According to articles 25 to 36 of the Declaration, States shall uphold the right to the free, prior and informed consent of indigenous peoples and avoid, minimize and adjudicate disputes concerning land, territory or resources arising from extractive industries, large-scale water, energy and infrastructure projects, and agricultural investments.

The Permanent Forum recommends that a capacity-development component be included in UNDP projects that affect indigenous peoples. The Forum also recommends that the experience and knowledge of the Small Grants Programme of the Global Environmental Facility be utilized by other small-grant schemes and that a stronger link be developed between efforts to enhance the capacity of indigenous peoples’ organizations and UNDP efforts to enhance the participation of indigenous peoples in national policy processes

The Permanent Forum recognizes the instrumental role of the Indigenous Peoples’ Centre for Documentation, Research and Information in providing essential services to indigenous peoples and encourages United Nations bodies and agencies to facilitate the work of indigenous delegates representing indigenous peoples within the United Nations system by establishing partnerships with the Centre, and to facilitate its financing.

Recognizing that the creative economy is among the most dynamically developing economic sectors, and noting its capacity for the sustainable development, the Permanent Forum recommends that the United Nations Industrial Development Organization develop, in cooperation with indigenous peoples and Member States, a comprehensive programme for the development of indigenous businesses and creative industries, including through capacity-building programmes on entrepreneurship for indigenous peoples and mechanisms for financial support to start-ups. In that regard, funding from Member States for the development of start-up incubators based on cultural heritage, traditional occupations, crafts and knowledge is encouraged.

The Permanent Forum welcomes the efforts of UNDP to endorse the political participation of indigenous peoples in Latin America and the Caribbean and its support in the preparation of the report on democracy and indigenous peoples in the region. The Permanent Forum has paid particular attention to the participation and representation of indigenous peoples in development processes, such as those related to the Millennium Development Goals, data collection and disaggregation, and urban indigenous peoples and migration. The Forum has recommended on numerous occasions that United Nations agencies, international financial institutions and other development actors change their paradigms and approaches to their work with indigenous peoples. This includes increased mainstreaming of indigenous peoples’ issues in their work, respect for the principle of free, prior and informed consent, recognition of collective rights, including treaty rights, and increased participation of indigenous peoples, including women, in programme design, implementation and monitoring.

The Permanent Forum encourages the Food and Agriculture Organization of the United Nations (FAO), jointly with other United Nations agencies, to support the consolidation of the already established communication platforms in Latin America and Canada and to establish platforms in Asia and Africa and the Pacific. The Forum recommends that FAO and other agencies strengthen the reporting and monitoring mechanisms for the communication platforms, especially with a view to supporting indigenous peoples with a monitoring mechanism for their territories.

The Forum anticipates that the host country will do its utmost to assure the issuance in a timely manner of entry visas to members of the Forum and observers from non-governmental organizations, pursuant to article IV, section 11, of the Headquarters Agreement, in order to attend its sessions. The Forum also anticipates that other member States hosting United Nations meetings to which indigenous organizations are invited will also do their utmost to ensure the timely issuance of entry visas. The Forum further requests that consideration be given to the waivering of visa fees by host countries for applicants wishing to participate in the work of the Forum and related meetings and activities.

The Permanent Forum recommends that States, the United Nations system and other intergovernmental organizations provide political, institutional and, in accordance with article 42 of the United Nations Declaration on the Rights of Indigenous Peoples, financial support to the efforts of indigenous peoples so that they may consolidate their own development models and concepts and practices of living well (for example sumak kawsay, suma qamaña, laman laka, gawis ay biag), which are underpinned by their indigenous cosmologies, philosophies, values, cultures and identities, as well as link efforts to implement the Declaration.
