The Permanent Forum notes the progress achieved by the Regional Bureau for Latin America and the Caribbean of the United Nations Development Programme (UNDP) in the implementation of a programme on electoral processes with a focus on indigenous women and youth. However, the Permanent Forum is concerned about the Regional Initiative on Indigenous Peoples’ Rights and Development in Asia and the Pacific, a programme that has critically contributed to promoting indigenous peoples’ issues and rights in the region. The Permanent Forum urges UNDP to maintain and strengthen this important programme.

On the basis of the Permanent Forum’s continued concern about the impact of environmental toxins and the export and import of banned pesticides on the reproductive health of indigenous women and girls, the Forum reaffirms its call, contained in its report on its thirteenth session, for a legal review of the United Nations chemical conventions, in particular the Rotterdam Convention, to ensure that they are in conformity with international human rights standards, including the United Nations Declaration on the Rights of Indigenous Peoples and the Convention on the Rights of Persons with Disabilities (E/2014/43-E/C.19/2014/11, para. 16; see also E/C.19/2014/8, para. 62). The Forum recommends that the Convention on the Rights of the Child, in particular article 24, and its recognition of environmental health as a right protected under the Convention also be considered in the legal review. The Forum invites the Special Rapporteur on the implications for human rights of the environmentally sound management and disposal of hazardous substances and wastes to carry out a review within his mandated area of expertise and to present his conclusions to the Forum at its seventeenth session.

Recognizing the deep spiritual relationship indigenous peoples have with water, and the great respect they have for the natural laws governing the health and the sanctity of water, the Permanent Forum recommends that States review, with the direct participation of indigenous peoples, their laws on water regulation and the treaties, land claims and self-government agreements that they have entered into with indigenous peoples, taking into account the sanctity of water reflected in those agreements. It is further recommended that States present their reviews to the eighth session of the Permanent Forum in 2009, including in particular, information on the status of the implementation of laws and agreements with respect to water and indigenous peoples.

The Permanent Forum welcomes the invitation from the Government of the Russian Federation, the Governor of Yamal-Nenets Autonomous Region, the public chamber of the Russian Federation and the Russian Association of Indigenous Peoples of the North, Siberia and the Far East (RAIPON) to hold an international meeting in the city of Salekhard, from 1 to 4 July 2007, dedicated to the study of experiences of interaction between indigenous peoples and the private sector, and expresses its appreciation for this invitation. The Permanent Forum also calls upon other States to follow the example of the Russian Federation.

The Permanent Forum welcomes the adoption of resolution 63/278, by which the General Assembly established International Mother Earth Day and embraces indigenous peoples’ and Member States’ recommendations regarding the need to promote humankind living in harmony with nature. Therefore, the Forum decides to appoint Mr Carlos Mamani Candori and Mr Bartolome Clavero, members of the Forum as Special Rapporteurs, to conduct a study, without financial implications, on its implementation, taking into account, inter alia, the consideration and recognition of Mother Earth rights and submit a report to the ninth session of the Forum in 2010.

The Permanent Forum reiterates its concern about conservation efforts, including the designation of national parks, biosphere reserves and world heritage sites, which frequently lead to the displacement of indigenous peoples from their traditional lands and territories. In this regard, the Permanent Forum requests that a member of the Forum attend the thirty-fourth session of the UNESCO World Heritage Committee, to be held in Brasilia, Brazil, in August 2010.

The Permanent Forum commends the Pan American Health Organization for its work on Indigenous maternal and child health and encourages WHO to replicate this work in other regions. The Permanent Forum recommends that WHO include Indigenous Peoples’ organizations and Permanent Forum members in developing and implementing health strategies in the negotiations on a global accord on pandemic prevention, preparedness and response.

The Permanent Forum urges Member States to include indigenous peoples’ rights in the outcomes of the 2019 Climate Summit called for by the Secretary- General, which will be held on 23 September 2019. The Forum also recommends that States, the United Nations system, indigenous peoples’ organizations and other partners secure funding to ensure the adequate participation of indigenous peoples at the Summit and at the preparatory meetings.
