The Permanent Forum greatly welcomes the new global indigenous peoples’ partnership initiative that UNDP is developing with the International Labour Organization (ILO) and OHCHR to promote the United Nations Declaration on the Rights of Indigenous Peoples and ILO Convention No. 169. The Permanent Forum hopes to support that initiative, working in cooperation with other actors, by providing advice during the initial phase as well as throughout the process.

The Permanent Forum recognizes the harm that the recent decision of the European Parliament regarding the seal product import ban may cause Inuit in the Arctic, and calls upon the European Union to rescind this import ban and, failing that, to enter into direct and meaningful dialogue with the Inuit Circumpolar Council to discuss ways of moving forward. Furthermore, the European Union must make decisions that affect both European and non-European indigenous peoples taking into account their right to free, prior and informed consent.

The Permanent Forum appoints Ms. Victoria Tauli-Corpuz and Mr. Pavel Sulyandziga as special rapporteurs to elaborate papers on indigenous peoples and relevant thematic issues relating to sustainable development (for example, sustainable agriculture, land, rural development, drought and desertification), for consideration by the Commission on Sustainable Development and for the submission of its reports to the Secretary-General and to represent the Permanent Forum in the Commission’s interactive dialogues with United Nations agencies. The Commission is urged to invite a member of the Permanent Forum to attend its annual sessions.

In the light of the study by Ms. Toki on the relationship between indigenous peoples and the Pacific Ocean and the dire effects of climate change, such as forced relocation and the loss of culture and livelihood, on vulnerable small island Pacific States, the Permanent Forum recommends that United Nations entities, including UN-Oceans, the United Nations Framework Convention on Climate Change and UNESCO, in addition to the International Seabed Authority, comply with and implement the relevant articles of the United Nations Declaration (arts. 18, 27 and 32), so as to ensure the full and effective participation of indigenous peoples. This should include meaningful participation, such as dedicated indigenous representation within each of these United Nations entities, and regard for indigenous peoples’ world views.

The Forum recommends that the Convention on Biological Diversity and other relevant United Nations bodies such as UNEP, the Global Environmental Facility (GEF), UNDP, the United Nations Framework Convention on Climate Change, the World Bank, WIPO, the United Nations Convention to Combat Desertification, the Convention on International Trade in Endangered Species of Wild Fauna and Flora and the Ramsar Convention on Wetlands, support indigenous peoples’ organizations in order to develop capacity on research, work and proposals on human indicators applicable to the implementation of the environmental conventions and the plans and programmes of work of the Convention on Biological Diversity.

The Permanent Forum calls upon the Conference of the Parties and the secretariat of the United Nations Framework Convention on Climate Change to ensure that all reducing emissions from deforestation and degradation mechanism (REDD and REDD+) programmes and projects go through a full review, with the full and effective participation of Indigenous Peoples, to assess their validity. The parties to the Convention should adopt a grievance mechanism that allows Indigenous Peoples to identify and name non-State actors, corporations, United Nations entities, States and other organizations involved in setting up REDD programmes and projects that violate the rights of Indigenous Peoples.

The Permanent Forum calls upon Member States to start the work, in the context of the United Nations Convention on the Law of the Sea, of creating a place and a voice for indigenous peoples in the governance of the world’s oceans. This effort involves the participation of indigenous peoples in all aspects of the work and decision-making regarding the Convention on the Law of the Sea, including the environmental provisions and the delimitation of the continental shelf. It may also include establishing advisory committees of indigenous peoples to guide the work under the Convention, as has been done under the Convention on Biological Diversity.

The Permanent Forum congratulates the International Fund for Agricultural Development (IFAD) on the establishment of an indigenous peoples’ forum on 18 February 2011. This is consistent with international standards and, in particular, with the United Nations Declaration on the Rights of Indigenous Peoples. It is also an example of good practice to be followed by other United Nations entities. The Forum encourages IFAD to: (a) actively promote the participation of indigenous peoples’ organizations in country strategies and programme cycles; (b) improve the design, monitoring and evaluation of IFAD-funded projects by using specific indicators for the well-being of indigenous peoples and by promoting an independent assessment of such projects by indigenous peoples; and (c) improving its advocacy role in disseminating its best practices in terms of development approaches with indigenous peoples at the national, regional and international levels.

The Forum recommends that States, United Nations agencies, bodies and funds, other multilateral bodies and financial institutions and other donors provide technical and financial support to protect and nurture indigenous peoples’ natural resource management, environment-friendly technologies, biodiversity and cultural diversity and low-carbon, traditional livelihoods (pastoralism; rotational or swidden agriculture; hunting and gathering and trapping; marine and coastal livelihoods; high mountain agriculture; etc.). The Forum further recommends that discussions and negotiations on strengthening the links between climate change, biodiversity and cultural diversity under the Convention on Biological Diversity or the United Nations Framework Convention on Climate Change ensure the effective participation of indigenous peoples.
