The Permanent Forum reiterates its concern about conservation efforts, including the designation of national parks, biosphere reserves and world heritage sites, which frequently lead to the displacement of indigenous peoples from their traditional lands and territories. In this regard, the Permanent Forum requests that a member of the Forum attend the thirty-fourth session of the UNESCO World Heritage Committee, to be held in Brasilia, Brazil, in August 2010.

The Permanent Forum welcomes the “International Conference on Biological and Cultural Diversity: Diversity for Development and Development for Diversity” (8-10 June 2010, Montreal, Canada) as a useful dialogue on the interface of diversities and development and notes its goal to consider a future collaborative programme of work between the Secretariat of the Conference on Biological Diversity, the United Nations Educational, Scientific and Cultural Organization (UNESCO), other relevant agencies, including the Forum and relevant indigenous organizations and non-governmental organizations, and decides to send the Chair of the Forum to report on the outcomes of the ninth session of the Permanent Forum regarding the theme.

The Permanent Forum recommends that the United Nations Educational, Scientific and Cultural Organization (UNESCO) and the International Fund for Agricultural Development (IFAD) establish an institutional partnership with indigenous peoples so that they can fully participate in the monitoring and other mechanisms of UNESCO conventions and IFAD projects and programmes that are relevant to indigenous peoples. The Permanent Forum further recommends that UNESCO establish an advisory group of indigenous experts to provide advice.

The Permanent Forum has paid particular attention to the participation and representation of indigenous peoples in development processes, such as those related to the Millennium Development Goals, data collection and disaggregation, and urban indigenous peoples and migration. The Forum has recommended on numerous occasions that United Nations agencies, international financial institutions and other development actors change their paradigms and approaches to their work with indigenous peoples. This includes increased mainstreaming of indigenous peoples’ issues in their work, respect for the principle of free, prior and informed consent, recognition of collective rights, including treaty rights, and increased participation of indigenous peoples, including women, in programme design, implementation and monitoring.

Recognizing the deep spiritual relationship indigenous peoples have with water, and the great respect they have for the natural laws governing the health and the sanctity of water, the Permanent Forum recommends that States review, with the direct participation of indigenous peoples, their laws on water regulation and the treaties, land claims and self-government agreements that they have entered into with indigenous peoples, taking into account the sanctity of water reflected in those agreements. It is further recommended that States present their reviews to the eighth session of the Permanent Forum in 2009, including in particular, information on the status of the implementation of laws and agreements with respect to water and indigenous peoples.

The Permanent Forum recognizes that the United Nations has declared 2010 the International Year of Biodiversity and that indigenous peoples, as custodians of the Earth’s biodiversity, should be major players in actions planned for 2010. In that spirit, the Permanent Forum calls for close cooperation between the secretariat of the Convention on Biological Diversity and the Forum in promoting the International Year and in highlighting the role of indigenous peoples as custodians of biodiversity.

States should recognize indigenous peoples’ rights to forests and should review and amend laws that are not consistent with the United Nations Declaration on the Rights of Indigenous Peoples and other international standards on indigenous peoples’ land and natural resource rights, including over forests. This includes indigenous peoples’ customary law on land and resource rights and the right to be fully involved in decision-making processes.

The Permanent Forum notes the progress achieved by the Regional Bureau for Latin America and the Caribbean of the United Nations Development Programme (UNDP) in the implementation of a programme on electoral processes with a focus on indigenous women and youth. However, the Permanent Forum is concerned about the Regional Initiative on Indigenous Peoples’ Rights and Development in Asia and the Pacific, a programme that has critically contributed to promoting indigenous peoples’ issues and rights in the region. The Permanent Forum urges UNDP to maintain and strengthen this important programme.
