The Permanent Forum encourages Member States, in cooperation with United Nations agencies, to develop social policies that will enhance the production of indigenous peoples’ traditional foods and promote the restoration or recovery of lost drought-resistant indigenous food varieties to ensure food security. In this context, the Forum recommends that Burkina Faso, Mali and the Niger, as well as United Nations agencies such as FAO, IFAD and the Office for the Coordination of Humanitarian Affairs, establish a committee, in full consultation with and with the participation of indigenous peoples, aimed at preventing food crises in the sub Saharan region where indigenous peoples reside. The committee’s objective should be to prevent humanitarian disasters and, in particular, to prevent starvation at the same level as the disaster that struck the region in 1973.

The Permanent Forum greatly welcomes the new global indigenous peoples’ partnership initiative that UNDP is developing with the International Labour Organization (ILO) and OHCHR to promote the United Nations Declaration on the Rights of Indigenous Peoples and ILO Convention No. 169. The Permanent Forum hopes to support that initiative, working in cooperation with other actors, by providing advice during the initial phase as well as throughout the process.

The Permanent Forum recognizes the initial efforts made by FAO towards the elaboration of a methodological discussion platform to address indigenous peoples’ territorial rights. The Permanent Forum recommends that FAO and other interested or partner agencies continue the joint elaboration of the participatory methodology and start using it in the field in order to strengthen the delimitation, titling and negotiated development processes specifically targeting indigenous peoples’ needs

As part of the active engagement of IFAD with indigenous peoples’ issues, the Permanent Forum recommends that the Indigenous Peoples Assistance Facility be incorporated into the organization’s general budget so as to guarantee sustainability and the transfer of good practices and lessons learned within IFAD programmes and projects. The Permanent Forum also recommends that the facility extend its funding directly to indigenous peoples’ organizations. Support for indigenous peoples’ organizations should have as its point of departure the co-administration and co implementation of the projects.

The Permanent Forum is concerned that legal obligations and commitments and indigenous peoples’ treaties, agreements and other constructive arrangements with States are routinely denied and violated by States. With regard to interventions by indigenous peoples on unresolved land rights, including the Six Nations of the Grand River and others on which the Forum has made specific recommendations in the past, the Forum calls upon States to fairly and equitably redress the long-standing unresolved land rights issues through good-faith negotiations, consistent with the United Nations Declaration and without extinguishing indigenous peoples’ land rights.

Reiterating the recommendation made at its seventh session, the Permanent Forum recommends that the United Nations High Commissioner for Refugees and the International Organization for Migration focus on the vulnerability of indigenous peoples in the Pacific region, in particular in view of the effects of climate change (see E/2008/43-E/C.19/2008/13, chap. 1, sect. The Permanent Forum welcomes the adoption of resolution 63/278, by which the General Assembly established International Mother Earth Day and embraces indigenous peoples’ and Member States’ recommendations regarding the need to promote humankind living in harmony with nature. Therefore, the Forum decides to appoint Mr Carlos Mamani Candori and Mr Bartolome Clavero, members of the Forum as Special Rapporteurs, to conduct a study, without financial implications, on its implementation, taking into account, inter alia, the consideration and recognition of Mother Earth rights and submit a report to the ninth session of the Forum in 2010.

The Permanent Forum notes that various United Nations treaty bodies have repeatedly called on the Governments of Finland and Sweden to clarify and affirm the Sámi people’s rights to land and fishing, including hunting and reindeer grazing rights. The Forum urges Finland and Sweden to take action in accordance with these recommendations, without further delay. The Permanent Forum further calls on Norway to reach an agreement with the Sámi Parliament on the draft mineral act.
