The Permanent Forum welcomes the results of the 2018 High-level Expert Seminar on Indigenous Food Systems, in particular the creation of an online global hub on indigenous food systems, and would like to recommend that the Food and Agriculture Organization of the United Nations (FAO) continue work on: (a) Indigenous young people towards the creation of a forum on indigenous young people in the coming years; (b) Indigenous food systems, in particular in relation to the links with traditional knowledge, climate change and the respect of indigenous peoples’ rights to their lands, territories and resources; (c) Indigenous women (the global campaign on indigenous women and the leadership and food security schools for indigenous women).

The Permanent Forum recommends that all States that have introduced changes to existing indigenous land management regimes invite the Special Rapporteur on the situation of human rights and fundamental freedoms of indigenous people to undertake a study of those regimes and assess them against the principles contained in the Declaration on the Rights of Indigenous Peoples.

While the concept of indigenous peoples in Africa has been conceptualized and adopted by African Union bodies, including at the Heads of State summits, there remains a need to raise awareness of indigenous peoples on the continent and for robust and effective measures, including legislative measures, to ensure recognition of and respect for their human rights. Likewise, while the rights of indigenous peoples have been supported in African courts and in decisions by the African Commission on Human and Peoples’ Rights and the African Court on Human and Peoples’ Rights, gaps in implementation remain widespread. The Permanent Forum urges the concerned States to implement the decision of the African Commission on Human and Peoples’ Rights, including in the Endorois case; the order of provisional measures of the African Court on Human and Peoples’ Rights in the Ogiek case; and the decision of the High Court of Botswana in the case concerning the Kalahari Game Reserve. These cases are important because they contribute to the development of jurisprudence on the implementation of the United Nations Declaration on the Rights of Indigenous Peoples.

The Permanent Forum notes the progress achieved by the Regional Bureau for Latin America and the Caribbean of the United Nations Development Programme (UNDP) in the implementation of a programme on electoral processes with a focus on indigenous women and youth. However, the Permanent Forum is concerned about the Regional Initiative on Indigenous Peoples’ Rights and Development in Asia and the Pacific, a programme that has critically contributed to promoting indigenous peoples’ issues and rights in the region. The Permanent Forum urges UNDP to maintain and strengthen this important programme.

Mindful of the systemic discrimination and racism experienced by indigenous peoples in the law enforcement, judicial and correctional institutions of States across the globe, the Permanent Forum urges States that have ratified the International Covenant on Civil and Political Rights and the International Convention on the Elimination of all Forms of Racial Discrimination to comprehensively review the civil rights of indigenous peoples, in particular those of indigenous women and children who are victims of sexual violence, in order to ensure that they have fair, non-discriminatory access to justice.

The Permanent Forum welcomes the invitation from the Government of the Russian Federation, the Governor of Yamal-Nenets Autonomous Region, the public chamber of the Russian Federation and the Russian Association of Indigenous Peoples of the North, Siberia and the Far East (RAIPON) to hold an international meeting in the city of Salekhard, from 1 to 4 July 2007, dedicated to the study of experiences of interaction between indigenous peoples and the private sector, and expresses its appreciation for this invitation. The Permanent Forum also calls upon other States to follow the example of the Russian Federation.

The Permanent Forum is deeply concerned about the particular vulnerabilities
of indigenous children. In this regard, it notes the study of the Expert Mechanism on
the Rights of Indigenous Peoples on the rights of the indigenous child under the
United Nations Declaration on the Rights of Indigenous Peoples (A/HRC/48/74) and
the note by the Secretariat entitled “Update on the promotion and application of the
United Nations Declaration on the Rights of Indigenous Peoples: violence against
children” (E/C.19/2022/4), prepared in collaboration with the Special Representative
of the Secretary-General on Violence against Children. The Permanent Forum calls
upon Member States to prioritize the human rights of indigenous children and young
people, in cooperation with indigenous peoples. The Permanent Forum further calls
upon those States that have not yet ratified the Convention on the Rights of the Child,
including its three Optional Protocols – on a communications procedure, on the sale
of children, child prostitution and child pornography and on the involvement of
children in armed conflict, to do so as soon as possible.
