The religious, spiritual and cultural sites of indigenous peoples, including the Ktunaxa Nation in Canada, the Aboriginal people of Australia, the Maya of Guatemala and the Amazigh peoples, continue to face destruction. This has profoundly negative impacts on indigenous peoples, including affecting their sacred practices. Consistent with articles 11, 12, 13, 19, 25, 31 and 32 of the United Nations Declaration and paragraphs 20 and 27 of the outcome document of the World Conference on Indigenous Peoples, the Permanent Forum recommends that, in their national action plans, strategies and other measures, States:
(a) Take effective measures to ensure that indigenous peoples’ spiritual and cultural sites are protected;
(b) Ensure that, consistent with article 32 of the United Nations Declaration, indigenous peoples are not forced to defend these rights against proposed development projects or through litigation in courts;
(c) Actively resolve disputes directly with indigenous peoples, consistent with article 19 of the United Nations Declaration, given that these rights constitute critical elements of the survival, dignity and well-being of indigenous peoples.

The Permanent Forum urges the funds, programmes and agencies of the United Nations system to cooperate with States and indigenous peoples in the development and implementation of national action plans, strategies and other measures that aim to achieve the ends of the Declaration, including by providing support for the advancement and adjudication of the collective rights of indigenous peoples to their lands, territories and resources.

The Permanent Forum commends the UNDP Regional Bureau for Latin America and the Caribbean for starting a regional initiative building on the Programme’s experience in Asia. The Forum recommends that the initiative be consolidated and that the Regional Bureau implement a regional programme to ensure cross-fertilization of good practices among countries and coherent policy approaches. The Forum encourages the Regional Bureau to strengthen its capacity and, together with the Inter-Agency Support Group, looks forward to supporting those efforts through specialized training workshops for United Nations country teams.

Reiterating the recommendation made at its seventh session, the Permanent Forum recommends that the United Nations High Commissioner for Refugees and the International Organization for Migration focus on the vulnerability of indigenous peoples in the Pacific region, in particular in view of the effects of climate change (see E/2008/43-E/C.19/2008/13, chap. 1, sect. The Permanent Forum welcomes the role that the WIPO Voluntary Fund for Accredited Indigenous and Local Communities has played since 2005 in funding the participation of indigenous peoples in sessions of the Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore and calls upon States, foundations and other organizations to contribute to the Fund.

The Permanent Forum recommends that States take effective measures to halt land alienation in indigenous territories, for example, through a moratorium on the sale and registration of land, including the granting of land and other concessions in areas occupied by indigenous peoples, and also to assist indigenous communities, where appropriate, to register as legal entities.

The Permanent Forum supports the work of the Special Representative to urge States to integrate human rights into those areas that most affect business practices, including corporate law, export credit and insurance, investments and trade agreements. The Forum suggests that the Special Representative urge States to ensure that such business practices comply with the relevant provisions of the United Nations Declaration on the Rights of Indigenous Peoples. The Forum urges the Special Representative to incorporate the specific views and distinct perspectives of indigenous peoples on social and economic development. Regarding the Americas, corporations must also comply with therulings of the Inter-American Court of Human Rights, which construe the States’ obligations under International Labour Organization (ILO) Convention (No. 169) concerning Indigenous and Tribal Peoples in Independent Countries with regard to the Declaration as extending even to States that have not ratified the Convention. The Forum recommends that this principle be applied in other jurisdictions.

The Permanent Forum intends to make the formulation of an indigenous peoples’ development index, based on the human rights affirmed in the United Nations Declaration and international human rights instruments, a recurring part of its agenda. The Forum recommends that the United Nations Development Programme, especially its Human Development Report Office, and the Office of the United Nations High Commissioner for Human Rights assist the Forum in developing such an index, building on existing initiatives by indigenous peoples and United Nations agencies, and report thereon to the Forum at its fifteenth session

The Permanent Forum acknowledges the work of the International Telecommunication Union, in collaboration with indigenous peoples’ organizations, on digital inclusion training programmes in the Americas region. The Permanent Forum recognizes the need to undertake additional efforts aimed at eliminating the existing digital inequality affecting indigenous peoples and invite s the International Telecommunication Union to expand its programmes globally, with a special emphasis on nomadic and semi-nomadic indigenous peoples.

The Permanent Forum congratulates the International Fund for Agricultural Development (IFAD) for the approval of its policy on engagement with indigenous peoples, consistent with international standards, in particular with the United Nations Declaration on the Rights of Indigenous Peoples and the United Nations Development Group guidelines. In the implementation of the policy, the Forum encourages the Trust Fund to establish an indigenous peoples’ forum at IFAD, as an example of a good practice to be followed by other United Nations agencies and other intergovernmental organizations.
