The Permanent Forum recommends that an expert group meeting on urban indigenous peoples and migration be organized by the United Nations Human Settlements Programme (UN-Habitat) in cooperation with the secretariat of the Permanent Forum with the participation of the members of the Permanent Forum, experts from indigenous organizations, the United Nations system and other relevant intergovernmental organizations and interested Governments, for the purpose of formulating recommendations for consideration, as part of its preparatory work for the sixth session. The Permanent Forum requests donors to provide financial resources for this expert group meeting. The Permanent Forum invites the International Organization for Migration to assist in the preparations for this meeting.

The Permanent Forum welcomes the first meeting of Escazú Agreement. The Escazú Agreement is the first instrument that includes provisions on the protection of human rights defenders in environmental matters. The Permanent Forum urges States parties to ensure implementation of the Agreement and invites them to establish mechanisms for the full and effective participation of indigenous peoples in the work thereof. The Permanent Forum reiterates its invitation to countries that have not yet signed or ratified the Agreement to do so.

Recalling the recommendation contained in the report of its fifteenth session (E/2016/43-E/C.19/2016/11, para. 52), the Permanent Forum urges States to take measures for settlement, protection and security in post-conflict areas and for the construction of durable and lasting peace, promoting the full and effective inclusion of indigenous peoples, including indigenous women, in any initiative for peace and reconciliation. The Forum also recommends that the Department of Political and Peacebuilding Affairs and indigenous peoples, including women and young people, consider indigenous peoples’ traditional conflict resolution systems for achieving durable and lasting peace.

It also welcomes the indication by Canada in the 2010 Speech from the Throne that it will take steps to endorse the Declaration. The Forum recommends that the United States and Canada expedite their commitments made to endorse the Declaration

The Permanent Forum reiterates the regrets that it expressed at its twenty-first session regarding the very high and inhumane incarceration rates of Indigenous Peoples globally, which contribute to poor health, poverty and early and preventable deaths. The Permanent Forum repeats its previous recommendation to the Unit ed States of America on the grating of clemency to Leonard Peltier. Owing to his age and poor health, his release is a humanitarian imperative.

The Forum recommends that the United Nations and Member States recognize the cultural rights of indigenous peoples which include the rights to organize oneself freely and to administer one’s own cultural, sports, social and religious institutions. Indigenous peoples have a profound relationship with their environment. This includes their distinct rights to water. The Permanent Forum urges States to guarantee those rights, including the right to access to safe, clean, accessible and affordable water for personal, domestic and community use. Water should be treated as a social and cultural good, and not primarily as an economic good. The manner in which the right to water is realized must be sustainable for present and future generations. Moreover, indigenous peoples’ access to water resources on their ancestral lands must be protected from encroachment and pollution. Indigenous peoples must have the resources to design, deliver and control their access to water.
