The Permanent Forum appreciates the efforts made by the United Nations Collaborative Programme on Reducing Emissions from Deforestation and Forest Degradation in Developing Countries, which comprises the Food and Agriculture Organization of the United Nations, the United Nations Environment Programme and the United Nations Development Programme, to inform, consult and involve indigenous peoples in United Nations activities relating to reducing emissions from deforestation and forest degradation and encourages them to further consolidate the partnership

The Permanent Forum appoints Mr. Michael Dodson, a member of the Forum, as a special rapporteur to prepare a draft guide, based on the relevant principles contained in the Declaration on the Rights of INdigenous Peoples, taking into account the provisions of ILO Convention 169 that relate to indigenous land tenure and management arrangements, to assist indigenous peoples, States and United Nations agencies in negotiating indigenous land tenure and management arrangements.

The Permanent Forum has received information that indigenous peoples who have established community means of communication, such as film-makers and radio hosts, are criminalized and prosecuted for such activities, especially in Latin America. In this regard, the Forum requests parliamentarians to establish legal frameworks that respect the rights enshrined in the United Nations Declaration on the Rights of Indigenous Peoples and to end such practices.

The Permanent Forum invites Member States to participate in informal discussions on the effective and efficient impacts of the Permanent Forum on the achievement of the Sustainable Development Goals, including in the contexts of biodiversity, climate change, desertification and the enjoyment of human rights by indigenous peoples, in particular efforts to combat violence against indigenous women and children. The Permanent Forum also invites Member States to enhance the effective participation of indigenous peoples in the design and implementation of efforts in the context the United Nations Decade of Ocean Science for Sustainable Development; the International Decade for Action, “Water for Sustainable Development”, 2018–2028; the United Nations Decade on Ecosystem Restoration; and the International Decade of Indigenous Languages.

The Permanent Forum is concerned that, in their efforts to achieve the Sustainable Development Goals, Member States are not complying with the Declaration. In one case, the Committee on the Elimination of Racial Discrimination requested that Norway temporarily suspend the ongoing construction of the Fosen Vind onshore wind power project, which negatively affects the reindeer herding of the South Sami people. The Government of Norway, having concluded that its administrative and legal processes were sufficient, did not implement the interim measures. The Forum urges Member States to respect and comply with decisions made by the United Nations treaty bodies.

The Permanent Forum recommends that the Human Rights Council consider:(a)The inclusion of an agenda item addressing the human rights of indigenous peoples in the ongoing work of the Council;(b) Including the human rights of indigenous peoples as part of its universal periodic review;(c)The inclusion of indigenous expertise in the new general expert advisory body being established by the Human Rights Council;(d)The interventions submitted by an expert member of the Permanent Forum to the Human Rights Council and the working groups on the ongoing reforms of the human rights mechanisms;(e) Maintaining and strengthening its expertise on indigenous peoples’ human rights issues.

The Forum recommends:
(a) That the appropriate agencies, including those engaged in development activities, consider the protection of sacred species;
(b) That UNESCO focus attention on the ratification of the Convention on Intangible Cultural Heritage and on its effective implementation at national levels;
(c) That UNESCO explore the links between the protection of tangible cultural heritage, intangible cultural heritage and sacred sites and other related UNESCO instruments with a view to broadening, strengthening and streamlining the protection of (indigenous) cultural heritage;
(d) That UNESCO facilitate the participation of both the Forum and indigenous peoples’ representatives in all relevant meetings of interest to them;
(e) Noting that the current UNESCO endangered languages programme seeks only to record endangered (indigenous) languages, that UNESCO expand its endangered languages programme to record, revive and reintroduce indigenous languages, in cooperation with indigenous peoples. This should include projects that support training in and teaching of indigenous languages at the community level.

The Permanent Forum notes with concern the slow progress made in the negotiations on the final protocol on access and benefit-sharing. The Permanent Forum reiterates its requests to the parties to the Convention to take into account the United Nations Declaration on the Rights of Indigenous Peoples in the negotiation, adoption and implementation of the access and benefit-sharing protocol.
