The Permanent Forum was presented with horrific testimonies of Indigenous children incarcerated in prisons and other holding facilities. The Permanent Forum reminds Member States to fulfil their obligations under the Convention on the Rights of the Child in relation to the arrest, detention, or imprisonment of a child. No child should be in prison. In that regard, the Permanent Forum notes the finding in 2022 of the Supreme Court of Western Australia that the extensive solitary confinement and significant reduction in liberty of children, primarily Aboriginal children, was unlawful. The Permanent Forum calls upon Australia to respect the Court decision and remove its reservation to article 37 of the Convention on the Rights of the Child. The Permanent Forum recommends that Member States review and reform their child protection policies and systems to prevent undue removal of Indigenous children from their families and communities.

The Permanent Forum recommends that States implement the principles contained in General Comment No. 21 (2009) of the Committee on Economic, Social and Cultural Rights on article 15, paragraph 1 (a), of the International Covenant on Economic, Social and Cultural Rights regarding the right of everyone to take part in cultural life. In its interpretation of the article, the Committee takes into account the United Nations Declaration on the Rights of Indigenous Peoples. It consequently distinguishes the right of indigenous peoples to take part in their own culture from the same right as it applies to minorities. This distinction is made in particular as a result of the extension of the concept of indigenous culture to material aspects such as territories and resources.

The Permanent Forum recognizes that it is important that the Human Rights Council continues to effectively address indigenous peoples’ issues as human rights issues. The Permanent Forum decides to appoint Ms. Ida Nicolaisen and Mr. Wilton Littlechild to undertake a study on the structures, procedures and mechanisms that presently exist and that might be established to effectively address the human rights situation of indigenous peoples, to arrange for indigenous representation and inclusion in such structures, procedures and mechanisms and to submit a report on the subject to the Permanent Forum by 31 December 2007.

The Forum recommends:
(a) That the appropriate agencies, including those engaged in development activities, consider the protection of sacred species;
(b) That UNESCO focus attention on the ratification of the Convention on Intangible Cultural Heritage and on its effective implementation at national levels;
(c) That UNESCO explore the links between the protection of tangible cultural heritage, intangible cultural heritage and sacred sites and other related UNESCO instruments with a view to broadening, strengthening and streamlining the protection of (indigenous) cultural heritage;
(d) That UNESCO facilitate the participation of both the Forum and indigenous peoples’ representatives in all relevant meetings of interest to them;
(e) Noting that the current UNESCO endangered languages programme seeks only to record endangered (indigenous) languages, that UNESCO expand its endangered languages programme to record, revive and reintroduce indigenous languages, in cooperation with indigenous peoples. This should include projects that support training in and teaching of indigenous languages at the community level.

The Permanent Forum urges Member States to include indigenous peoples’ rights in the outcomes of the 2019 Climate Summit called for by the Secretary- General, which will be held on 23 September 2019. The Forum also recommends that States, the United Nations system, indigenous peoples’ organizations and other partners secure funding to ensure the adequate participation of indigenous peoples at the Summit and at the preparatory meetings.

The Permanent Forum calls upon States and corporations to fully recognize the presence and effective participation of indigenous peoples in all negotiation processes relating to the entry of extractive industries, infrastructure projects and other development projects into their communities, consistent with the United Nations Declaration on the Rights of Indigenous Peoples, inter alia, articles 19, 23 and 32. Furthermore, the Forum calls upon all relevant actors to ensure the application of culturally relevant, gender-balanced and gender-based analysis and gender budgeting as critical elements of economic and social development, consistent with articles 21 and 44 of the Declaration.

The Permanent Forum recommends that States discontinue all sedentarization and other programmes that coerce indigenous peoples to forsake shifting cultivation for other modes of cultivation without their free, prior and informed consent. Alternative modes of cultivation ensure food sovereignty, livelihood security, health security, educational security and forest conservation and other safeguards.
