Mindful of the systemic discrimination and racism experienced by indigenous peoples in the law enforcement, judicial and correctional institutions of States across the globe, the Permanent Forum urges States that have ratified the International Covenant on Civil and Political Rights and the International Convention on the Elimination of all Forms of Racial Discrimination to comprehensively review the civil rights of indigenous peoples, in particular those of indigenous women and children who are victims of sexual violence, in order to ensure that they have fair, non-discriminatory access to justice.

The Permanent Forum notes that indigenous youth in the region are often forced to leave their home and lands to receive an education, which can pose an obstacle to the right to education. The Permanent Forum urges States in Central and Eastern Europe, the Russian Federation, Central Asia and Transcaucasia to take measures to ensure the enjoyment of the right to education by indigenous youth. The Permanent Forum encourages States of the region to facilitate the development of indigenous peoples’ self-administration, the development of their inner potential and human resources, forming parliaments following the example of the Sami people; and decent representation of the small-numbered indigenous peoples in the bodies of legislative and executive power on all levels.

The Permanent Forum also notes the International Expert Group Meeting on Urban Indigenous Peoples and Migration, held in Chile in March 2007, and expresses its appreciation to the Government of Canada for providing funding to the Economic Commission for Latin America and the Caribbean for hosting the event. It also recommends that States, United Nations and civil society organizations and other stakeholders contribute to the implementation of the recommendations contained in the above-mentioned publication.

Indigenous peoples lack recognition, and face poor implementation of their
rights and flagrant violations of their rights and their lands, while the need for their free, prior and informed consent and the right to autonomy of self-government is disregarded by local businesses and transnational corporations in mining, logging, and oil and gas extraction, among other sectors. The territories and resources of indigenous peoples are seized and livelihoods are destroyed to the detriment of their knowledge, cultures and languages. In that respect, it is important to remind Member
States of their duty to protect.

While the concept of indigenous peoples in Africa has been conceptualized and adopted by African Union bodies, including at the Heads of State summits, there remains a need to raise awareness of indigenous peoples on the continent and for robust and effective measures, including legislative measures, to ensure recognition of and respect for their human rights. Likewise, while the rights of indigenous peoples have been supported in African courts and in decisions by the African Commission on Human and Peoples’ Rights and the African Court on Human and Peoples’ Rights, gaps in implementation remain widespread. The Permanent Forum urges the concerned States to implement the decision of the African Commission on Human and Peoples’ Rights, including in the Endorois case; the order of provisional measures of the African Court on Human and Peoples’ Rights in the Ogiek case; and the decision of the High Court of Botswana in the case concerning the Kalahari Game Reserve. These cases are important because they contribute to the development of jurisprudence on the implementation of the United Nations Declaration on the Rights of Indigenous Peoples.

The Permanent Forum urges OHCHR in the Plurinational State of Bolivia to continue and strengthen its monitoring of the human rights of the Guaraní people to address as a matter of urgency the situation of the families and communities that are subjected to forced labour and other forms of servitude and to report regularly and publicly on developments in that situation. In the area of technical assistance, the Permanent Forum urges OHCHR in the Plurinational State of Bolivia to strengthen the human rights capacities of the Guaraní authorities in Alto Parapetí and other districts where there are serious human rights violations.

The Permanent Forum urges that discussions at the forthcoming summit to renew the Amazon Cooperation Treaty Organization, scheduled to be held in Brazil in August 2023, fully involve Indigenous Peoples from the Amazon region in determining a road map that addresses their situation, including cross-border illegal activities and organized crime.
