The Permanent Forum welcomes the fact that the International Union for Conservation of Nature, in cooperation with indigenous peoples, is undertaking preparations for the World Summit of Indigenous Peoples and Nature to be convened during the upcoming World Conservation Congress, which will be held in Marseille, France, in September 2021. The summit is aimed at providing an opportunity to highlight and exchange information about the contributions of indigenous peoples to sustaining biodiversity, combating climate change and promoting sustainable development. The Forum recommends that Member States, international organizations and NGOs support the participation of indigenous peoples in the summit. The Forum invites the International Union for Conservation of Nature to share the outcomes of the summit at the Forum’s twenty-first session in 2022.

The Permanent Forum recalls that, to ensure effective implementation, the Guiding Principles on Business and Human Rights must be aligned with the United Nations Declaration on the Rights of Indigenous Peoples, the Indigenous and Tribal Peoples Convention, 1989 (No. 169), of ILO, the Regional Agreement on Access to Information, Public Participation and Justice in Environmental Matters in Latin America and the Caribbean, known as the Escazú Agreement, and the jurisprudence of the human rights treaty bodies. Furthermore, the Permanent Forum recognizes the work of the Human Rights Council to develop an international legally binding instrument to regulate, in international human rights law, the activities of transnational corporations and other business enterprises. In that respect, the Permanent Forum stresses the need to ensure that the new instrument affirms indigenous peoples’ rights, including with regard to free, prior and informed consent. The Permanent Forum recommends that this instrument explicitly define due diligence processes and their specific methods of implementation. Therefore, the Permanent Forum underlines the importance of full and effective participation by indigenous peoples throughout the development of the instrument.

The Permanent Forum welcomes the global synthesis report on indicators of well-being, poverty and sustainability relevant to indigenous peoples, which is the culmination of efforts by the United Nations system and indigenous peoples’ organizations over the past several years. The Forum invites the United Nations system, including the United Nations Development Group and the Inter-Agency Support Group, the donor community, States, indigenous peoples, non-governmental organizations and the private sector to use those indicators as a guide in programmes and projects directly or indirectly affecting indigenous peoples and their communities, in accordance with the standards set by the United Nations Declaration on the Rights of Indigenous Peoples.

The Permanent Forum welcomes the measures undertaken by several countries that aim, inter alia, to explore and develop alternative sources of income, significantly reduce the exploitation of natural resources, enhance conservation of biological diversity and establish measures in favour of indigenous peoples in voluntary isolation, such as the national initiative undertaken by Ecuador entitled “Yasuni-ITT initiative”. The Permanent Forum recommends that such measures respect the right to free, prior and informed consent of the indigenous peoples concerned.

The Permanent Forum reiterates its recommendation to adopt a programme of work on article 8 (j) and other provisions of the Convention on Biological Diversity and strengthened institutional arrangements through a permanent subsidiary body to take forward the Kunming-Montreal Global Biodiversity Framework and to ensure a human rights-based approach, and full and effective participation of Indigenous Peoples, by the sixteenth meeting of the Conference of the Parties to the Convention. The Permanent Forum recommends ensuring direct access to financial resources for Indigenous Peoples, inclusive of all landscapes and seascapes, more efficient financial mechanisms managed by Indigenous Peoples and the inclusion of Indigenous Peoples’ representatives in the governance of the Framework to better design and implement grants. The Permanent Forum welcomes the progress made in the development of community-based tools to monitor the implementation of the Declaration, the outcome document of the World Conference on Indigenous Peoples and the 2030 Agenda for Sustainable Development and encourages collaboration and contributions from Governments, the agencies of the United Nations system, indigenous peoples and civil society organizations to the Indigenous Navigator framework and other tools in order to strengthen community-based monitoring of global commitments made under the Declaration, the World Conference and the Sustainable Development Goals.

The Permanent Forum notes the intention of the International Indigenous Women’s Environmental Justice and Reproductive Health Initiative to organize an expert group meeting on the environment and indigenous women’s reproductive health and requests that the organizers invite members of the Permanent Forum to participate in the meeting. Further, the Permanent Forum recommends that the United Nations Population Fund (UNFPA) and the World Health Organization participate in the expert group meeting.

The Forum recommends that Governments provide public water and sanitation systems to the villages and rural areas where indigenous people live, and control the pollution of rivers and streams affected by pollution from such toxic chemicals as pesticides, herbicides, fertilizers and industrial waste. The Forum also recommends Governments to create programmes to clean up the rivers and streams that have already been polluted and to ban further pollution by agribusiness and industries.

The Permanent Forum urges the Governments of Central and Eastern Europe, the Russian Federation, Central Asia and Transcaucasia regions to implement international standards and norms on the rights of indigenous peoples and ensure their rights to lands, territories and resources, in particular article 20 of the Declaration. This includes recognizing reindeer herders’ use and management of grazing land and use of necessary biological resources by hunters, fishers and foragers.

The Forum recommends the creation of a global, legally binding regime for toxic industrial chemicals and hazardous pesticides, the vast majority of which are currently unregulated under existing conventions, to protect the rights of everyone, including indigenous peoples, from the grave threats to human rights presented by the ongoing chemical intensification of the global economy. Such a regime should have strong accountability and compliance mechanisms and be in conformity with international human rights standards, including the United Nations Declaration on the Rights of Indigenous Peoples.
