The Forum notes the preparation of the World Congress on Protected Areas, to be held in Durban, South Africa, in September 2003, which Forum members consider to be an important meeting calling for their attention and action. The Forum recommends that all laws, policies or work programmes on forests and protected areas guarantee, ensure and respect various aspects of indigenous peoples’ lives, such as their spiritual and cultural lives, lands and territorial rights, including sacred sites, needs and benefits, and recognize their rights of access to and control over the management of forests.

The Permanent Forum reiterates its call to Member States to establish mechanisms and processes for comprehensive dialogue and consultations with indigenous peoples in order to obtain their free, prior and informed consent in relation to any project that will have an impact on their territories and resources. In this regard, the Forum expresses concern regarding the lack of consultation by the Government of the Plurinational State of Bolivia with the indigenous peoples who will be affected by the mega-hydroelectric project of El Bala-Chepete and Rositas, including the Guarani, Mosetén, Tacana, Tsimané, Leco, Ese Ejja and Uchupiamona peoples. The Forum urges the Government of the Plurinational State of Bolivia to respect the fundamental rights of indigenous peoples and ensure that they are able to exercise their rights in accordance with international human rights standards.

The Permanent Forum commends States for recognizing the collective rights of indigenous peoples to lands, territories and resources and at the same time urges them to take immediate steps for the implementation of those rights through programmes for mapping, titling or other actions and legislative reforms. The Forum urges States to report to it by its twentieth session on steps taken in that regard.

The Permanent Forum urges States to review their policies on biofuel industries, which, in the name of remedying the impacts of climate change, are resulting in the deforestation of large forest areas and the displacement of indigenous peoples. The Forum recommends that the United Nations Convention to Combat Desertification, the Ramsar Convention on Wetlands, the Convention on the Conservation of Migratory Species of Wild Animals and the Convention on International Trade in Endangered Species of Wild Flora and Fauna facilitate the full and effective participation, including funding, of indigenous peoples, particularly women and youth, and the Forum in the work to implement these conventions, and involve them fully in policy formulation and in the design, implementation, monitoring and evaluation of environmental programmes or projects.

The Permanent Forum urges the International Union for Conservation of Nature to establish a task force on conservation and human rights to work with indigenous peoples’ communities and organizations to clearly articulate the rights of indigenous peoples in the context of conservation initiatives and to continue to promote grievance mechanisms and avenues for redress in the context of conservation action, including the Whakatane Mechanism. The Forum invites the Union to report on progress made in the implementation of these recommendations in future sessions.
