The Forum welcomes UNDP’s contribution to the Forum and its support of the establishment of a working group on free, prior and informed consent and of the initiative to develop a land rights policy. The Forum also recognizes the key role UNDP can play in data collection and disaggregation through its national human development reports and the Millennium Development Goals reports. The Forum also recognizes that the Goals can provide an overall framework for furthering indigenous peoples’ development.

The Permanent Forum recommends that Member States continue to develop legislation to support genuine indigenous representation and participation in decision-making. Legislative measures that create practical, economic, legal and political difficulties for the establishment and functioning of indigenous organizations and institutions worldwide should be addressed in order to allow for cross-border and international cooperation between indigenous peoples of different countries and with and within international organizations on issues and processes affecting them.

The Permanent Forum also recommends that States, United Nations organizations and indigenous peoples’ organizations strengthen the necessary communication, education and information infrastructure and support networks of educators on indigenous issues. Building upon the study prepared by members of the Permanent Forum on the situation of indigenous persons with disabilities, with a particular focus on challenges faced with respect to the full enjoyment of human rights and inclusion in development (see E/C.19/2013/6), and in the light of the call in the 2030 Agenda for Sustainable Development to “leave no one behind”, the Forum is concerned that the experiences and rights of indigenous persons with disabilities require further study and examination. In that regard, the Forum calls upon the secretariat of the Convention on the Rights of Persons with Disabilities, as the focal point within the United Nations system on matters relating to disability, to conduct a qualitative study with regard to indigenous persons with disabilities, in all seven regions of the world.

The Permanent Forum welcomes the initiative taken by the International Organization for Migration (IOM) and the secretariat of the Permanent Forum to convene a first expert meeting on the nexus between indigenous peoples and migration and endorses the recommendations of that meeting and requests further inter-agency cooperation and collaboration regarding data collection and case studies on indigenous peoples and migration, in particular the creation of a task force to specifically address migration issues of indigenous peoples within the existing Inter-Agency Support Group on Indigenous Issues for the Permanent Forum. Such a task force could assist with studies by indigenous leaders and experts and promote capacity-building projects dealing with the migration of indigenous peoples.

The Permanent Forum recommends to Member States that the development agenda beyond 2015 recognize indigenous peoples’ right to self-determination, autonomy and self-governance, together with their right to determine their own priorities for their development, to participate in governance and policy decision-making processes at the local, national, regional and international levels and to develop mechanisms for consultation and participation of indigenous peoples, building on the fundamental right to free, prior and informed consent and full participation in the development process. The role of the United Nations country teams in that respect is crucial.

Indigenous persons with disabilities face exceptionally difficult barriers both because they are indigenous and because they are disabled. The Permanent Forum recommends that States develop and provide full access to educational opportunities on an equitable basis and without discrimination for indigenous persons, as recognized in the United Nations Declaration on the Rights of Indigenous Peoples and in the Convention on the Rights of Persons with Disabilities. In particular, the Forum recommends that sign language education curricula be developed, in consultation with deaf indigenous persons, which reflect their cultures, issues, needs and preferences. Where there is State or international cooperation on education, indigenous persons with disabilities should be included. The Forum recommends that countries that have not yet ratified the Convention on the Rights of Persons with Disabilities do so urgently.
