The Permanent Forum welcomes the role that the WIPO Voluntary Fund for Accredited Indigenous and Local Communities has played since 2005 in funding the participation of indigenous peoples in sessions of the Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore and calls upon States, foundations and other organizations to contribute to the Fund.

The Permanent Forum regrets the very high incarceration rates of indigenous peoples globally, which contributes to poor health, poverty and untimely death, including in indigenous families and communities. States are reminded of their obligations under the International Covenant on Civil and Political Rights, the International Convention on the Elimination of All Forms of Racial Discrimination and the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, and should therefore address this issue urgently by reducing the incarceration and eliminating the cruel, inhuman and degrading treatment or punishment of indigenous peoples by justice systems.

The Permanent Forum urges UNDP to further strengthen the right to self-determination of indigenous peoples by choosing indigenous peoples’ organizations as their implementing partners and responsible parties in their projects involving indigenous peoples, especially those with established track records in project implementation. The ongoing COVID-19 pandemic has highlighted the urgent need for the collection of disaggregated statistical data on the situation of indigenous peoples. Where such data are available, they have shown that the pandemic has affected indigenous peoples differently than other populations, requiring culturally appropriate approaches and solutions. The Permanent Forum reiterates its recommendation to Member States to collect and disseminate disaggregated statistical data on indigenous peoples, in close cooperation with indigenous peoples themselves, in order to support evidence-based policymaking and programming.

The Permanent Forum reminds the Secretary-General, through the Assistant Secretary-General for Human Rights, on the continuing relevance of monitoring and reporting on trends related to intimidation and reprisals against Indigenous Peoples who seek to engage with the United Nations. Indigenous Peoples’ representatives have a right to be protected from reprisals for their participation in meetings at the United Nations, including the Permanent Forum on Indigenous Issues and the Expert Mechanism on the Rights of Indigenous Peoples.
