The Forum takes note of the report of the Special Rapporteur on the situation of human rights and fundamental freedoms of indigenous people to the Commission on Human Rights submitted in 2005 (E/CN.4/2005/88), the report of a seminar on education and indigenous peoples organized by the Office of the United Nations High Commissioner for Human Rights and UNESCO held in Paris (E/CN.4/2005/88/Add.4), on a workshop on higher education and indigenous peoples in Costa Rica in 1999 (E/CN.4/Sub.2/AC.4/1999/5) and the minimum standards for education in emergencies, chronic crises and early reconstruction developed by the Inter-Agency Network for Education in Emergency, and underlines that their recommendations should be promoted through good practices throughout the United Nations system and broadly to all Member States

The Permanent Forum recommends that Member States and United Nations agencies recognize indigenous peoples as distinct stakeholders and make a specific separate reference to indigenous peoples, and not simply include them under the terms “marginalized and vulnerable groups”, in both the sustainable development goals and the post-2015 development agenda, including the Small Island Developing States process, and that this recommendation, with the specific recognition of indigenous peoples’ views and priorities for development, should be reflected in the goals and targets to be developed, including appropriate indicators and data disaggregation.

The Permanent Forum reiterates its invitation to the Committee on the Elimination of Discrimination against Women to adopt a general recommendation on indigenous women by 2020, in accordance with the Declaration and other international instruments. The Forum recommends that the general recommendation on indigenous women consider issues related to the individual and collective rights to equality, non-discrimination and self-determination; social and economic rights, including the rights to decent work and to land, territory and resources; the right to water and food; cultural rights; civil and political rights; and the right to live free of any form of violence.

The Permanent Forum urges its secretariat, in cooperation with the secretariat of the Convention on Biological Diversity, to organize a side-event on the occasion of the fifth meeting of the Ad Hoc Open-ended Working Group on Access and Benefit-sharing of the Convention on Biological Diversity, as an occasion for the co-chairs of the Working Group, States parties and other interested groups to consider the conclusions and recommendations contained in the report of the international expert group meeting, held from 17 to 19 January 2007, on the Convention on Biological Diversity’s international regime on access and benefit-sharing and indigenous peoples’ human rights.

The Forum decides to appoint Victoria Tauli-Corpuz and Lars Anders-Baer, members of the Permanent Forum, as special rapporteurs to prepare a report on various models and best practices of mitigation and adaptation measures undertaken by indigenous peoples from various parts of the world. The Forum requests that these special rapporteurs, in collaboration with indigenous peoples, also prepare a draft declaration of action on climate change and indigenous peoples, which can include a road map for indigenous peoples towards the 2009 Copenhagen Conference of the Parties to the United Nations Framework Convention on Climate Change and beyond. These will be presented at the eighth session of the Forum.

Indigenous peoples have been a distinct constituency at the United Nations since 1977 and, with the adoption of the United Nations Declaration on the Rights of Indigenous Peoples by the General Assembly in 2007, their inherent rights were affirmed as the international minimum standard. The Permanent Forum reiterates the position of the Special Rapporteur on the rights of indigenous peoples, namely that it is unacceptable to undermine the status and standing of indigenous peoples by combining or equating them with non-indigenous entities such as minorities, vulnerable groups or local communities. Such attempts, whether by States or United Nations entities, are not acceptable and will be challenged by indigenous peoples and those mandated to defend their rights. The Permanent Forum urges all United Nations entities and States parties to treaties concerning the environment, biodiversity and the climate to eliminate the use of the term “local communities” in conjunction with indigenous peoples, so that the term “indigenous peoples and local communities” would be abolished.

The Permanent Forum welcomes the document of the Commission of the European Communities (COM (2008)), Communication from the Commission to the European Parliament and the Council: The European Union and the Arctic Region delivered in Brussels on 20 November 2008 and urges the European Union to begin implementing the recommendations relevant to indigenous peoples from this document.
