The Permanent Forum welcomes the decision 2009/250 of the Economic and Social Council on a proposed amendment to the Single Convention on Narcotic Drugs of 1961 as amended by the 1972 Protocol, related to the traditional use of the coca leaf. The Forum recommends that Member States support this initiative, taking into account articles 11, 24 and 31 of the United Nations Declaration on the Rights of Indigenous Peoples.

The Permanent Forum recognizes the importance of indigenous peoples knowledge systems as the basis of their development with culture and identity and therefore recommends that ongoing international processes, such as negotiations on the international regime on access and benefit-sharing of the Convention on Biological Diversity, the Ad Hoc Working Group on Long-term Cooperative Action of the United Nations Framework Convention on Climate Change, and the Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore of the World Intellectual Property Organization, should recognize and integrate the crucial role and relevance of indigenous knowledge systems in accordance with the United Nations Declaration on the Rights of Indigenous Peoples.

The Forum urges Governments, in addressing economic and social development issues, to make efforts to adopt general strategies that include considerations for the needs and rights of indigenous peoples in the policies, laws and administrative issues that affect them, and they should include participation and consultations with indigenous peoples. Governments should also consider implementing special policies directed to employment creation for indigenous peoples, facilitating access to credit and the creation of small and medium-sized businesses.

The Permanent Forum reiterates its concern about conservation efforts, including the designation of national parks, biosphere reserves and world heritage sites, which frequently lead to the displacement of indigenous peoples from their traditional lands and territories. In this regard, the Permanent Forum requests that a member of the Forum attend the thirty-fourth session of the UNESCO World Heritage Committee, to be held in Brasilia, Brazil, in August 2010.

The Permanent Forum recommends that Member States, the Open Working Group on Sustainable Development Goals and the United Nations system ensure that the processes relating to the definition of the development agenda beyond 2015 are formulated in accordance with the objectives of sustainable development, as defined in the Indigenous Peoples’ International Declaration on Sustainable Development and Self-Determination, adopted by the Indigenous Peoples’ International Conference on Sustainable Development and Self-Determination, held in Rio de Janeiro, Brazil, in 2012, and also recommends that culture be affirmed as the fourth pillar of sustainable development.

The Permanent Forum calls upon the Conference of the Parties and the secretariat of the United Nations Framework Convention on Climate Change to ensure that all reducing emissions from deforestation and degradation mechanism (REDD and REDD+) programmes and projects go through a full review, with the full and effective participation of Indigenous Peoples, to assess their validity. The parties to the Convention should adopt a grievance mechanism that allows Indigenous Peoples to identify and name non-State actors, corporations, United Nations entities, States and other organizations involved in setting up REDD programmes and projects that violate the rights of Indigenous Peoples.

The Permanent Forum recommends that international financial institutions unequivocally acknowledge the collective right of indigenous peoples to their lands, territories and resources in their safeguard policies and in all development project contexts (not merely in exceptional circumstances). Banks should not support any projects that affect indigenous peoples without prior recognition of and effective guarantees for their collective rights to own, control and manage their lands, territories and resources.

The Permanent Forum urges the funds, programmes and specialized agencies to have a special focus on the implementation of the United Nations Declaration on the Rights of Indigenous Peoples and the system-wide action plan in a few designated countries in 2017 and 2018 and led by the United Nations resident coordinators. In selecting those countries for joint action, special attention should be given to countries that already are under focus, such as those that are carrying out voluntary national reviews for the high-level political forum on sustainable development, those that are under review by the Working Group on the Universal Periodic Review, those that are in the preparatory phases for a new United Nations Development Assistance Framework, or those in which a dialogue process between the State and the indigenous peoples is taking place.

Recognizing the deep spiritual relationship indigenous peoples have with water, and the great respect they have for the natural laws governing the health and the sanctity of water, the Permanent Forum recommends that States review, with the direct participation of indigenous peoples, their laws on water regulation and the treaties, land claims and self-government agreements that they have entered into with indigenous peoples, taking into account the sanctity of water reflected in those agreements. It is further recommended that States present their reviews to the eighth session of the Permanent Forum in 2009, including in particular, information on the status of the implementation of laws and agreements with respect to water and indigenous peoples.

The Permanent Forum further urges resident coordinators to prepare their United Nations Sustainable Development Cooperation Frameworks to support the full and effective participation of indigenous peoples in strategic plans for their economic recovery. Resident coordinators are invited to provide an update to future sessions of the Permanent Forum through the Development Coordination Office on how the strategic recovery plans were developed and implemented.
