The continuing denial of indigenous peoples’ rights to lands, territories and resources, based upon various racist doctrines, theories and policies, including on lands occupied or otherwise used, historically and currently, by them, has led, among others, to their eviction from their lands and the erosion of their hunting and other traditional occupations and lifestyles, thereby threatening their very survival and well-being as peoples. It is necessary to ensure that bans, such as on hunting and other traditional livelihoods, do not infringe upon the rights of indigenous peoples.

The Permanent Forum recommends that States immediately begin the process of demarcation of indigenous peoples’ lands and territories in accordance with customary laws and the norms reflected in the United Nations Declaration on the Rights of Indigenous Peoples, with a view to further protecting indigenous peoples’ lands and resources from expropriation, exploitation and designation as conservation areas or national parks without the free, prior and informed consent of indigenous peoples, as set out in articles 19, 26 and 27 of the Declaration.

Consistent with articles 18 and 19 of the United Nations Declaration and in line with the implementation of the 2030 Agenda for Sustainable Development, with the call to “leave no one behind”, the Permanent Forum strongly recommend that States and funds, programmes and specialized agencies of the United Nations system ensure the disaggregation of data on the basis of indigenous identifiers/ethnicity and the full and effective participation of indigenous peoples in developing and monitoring national action plans and in all processes relating to the follow-up to and review of the implementation of the Sustainable Development Goals, including at the high-level political forum on sustainable development.

The Permanent Forum recommends that States take effective measures to halt land alienation in indigenous territories, for example, through a moratorium on the sale and registration of land, including the granting of land and other concessions in areas occupied by indigenous peoples, and also to assist indigenous communities, where appropriate, to register as legal entities.

The Permanent Forum reiterates its recommendation to adopt a programme of work on article 8 (j) and other provisions of the Convention on Biological Diversity and strengthened institutional arrangements through a permanent subsidiary body to take forward the Kunming-Montreal Global Biodiversity Framework and to ensure a human rights-based approach, and full and effective participation of Indigenous Peoples, by the sixteenth meeting of the Conference of the Parties to the Convention. The Permanent Forum recommends ensuring direct access to financial resources for Indigenous Peoples, inclusive of all landscapes and seascapes, more efficient financial mechanisms managed by Indigenous Peoples and the inclusion of Indigenous Peoples’ representatives in the governance of the Framework to better design and implement grants. The Permanent Forum commends the inclusion by the European Bank for Reconstruction and Development of free, prior and informed consent in its policy on indigenous peoples, and strongly urges other multilateral and bilateral financial institutions to follow this example. In particular, the Forum calls upon the Asian Development Bank to ensure that free, prior and informed consent and the provisions of the United Nations Declaration on the Rights of Indigenous Peoples are integrated into its revised policy on indigenous peoples. It also calls upon the World Bank and the International Finance Corporation to review their policies and adopt free, prior and informed consent as the central principle in their dealings with indigenous peoples instead of the present free, prior, informed consultation. The international financial institutions should develop a strategy to raise staff awareness at the national and headquarters levels on indigenous peoples’ rights and development perspectives and thereby improve their relationships with indigenous peoples at the country level.

The Permanent Forum urges States to address the stark inequality between indigenous and non-indigenous people in all aspects of life, which has been heightened as a result of COVID-19, by implementing in full the Indigenous and Tribal Peoples Convention, 1989 (No. 169), the United Nations Declaration on the Rights of Indigenous Peoples and the American Declaration on the Rights of Indigenous Peoples in all their legal norms and public policies related to indigenous peoples.

The Forum decides to appoint Victoria Tauli-Corpuz and Lars Anders-Baer, members of the Permanent Forum, as special rapporteurs to prepare a report on various models and best practices of mitigation and adaptation measures undertaken by indigenous peoples from various parts of the world. The Forum requests that these special rapporteurs, in collaboration with indigenous peoples, also prepare a draft declaration of action on climate change and indigenous peoples, which can include a road map for indigenous peoples towards the 2009 Copenhagen Conference of the Parties to the United Nations Framework Convention on Climate Change and beyond. These will be presented at the eighth session of the Forum.

The Permanent Forum encourages Member States, in cooperation with United Nations agencies, to develop social policies that will enhance the production of indigenous peoples’ traditional foods and promote the restoration or recovery of lost drought-resistant indigenous food varieties to ensure food security. In this context, the Forum recommends that Burkina Faso, Mali and the Niger, as well as United Nations agencies such as FAO, IFAD and the Office for the Coordination of Humanitarian Affairs, establish a committee, in full consultation with and with the participation of indigenous peoples, aimed at preventing food crises in the sub Saharan region where indigenous peoples reside. The committee’s objective should be to prevent humanitarian disasters and, in particular, to prevent starvation at the same level as the disaster that struck the region in 1973.
