The Forum expresses concern over development practices that do not take into account the particular characteristics of indigenous communities as groups, with their distinct cultural identities and often their own systems of representation, thus significantly undermining meaningful ways of participation in the assessment, preparation, execution and evaluation of development programmes of their concern.

The Forum, taking into account that States recognized the vital role of indigenous peoples in sustainable development at the World Summit on Sustainable Development, held in Johannesburg, South Africa, calls upon the United Nations system, other intergovernmental organizations and Governments to establish processes of meaningful participation and partnership with indigenous communities in those processes, including within the context of the United Nations Development Assistance Framework and the poverty reduction strategy papers of the World Bank. The Forum recommends, through the Economic and Social Council, that all States, organs and agencies of the United Nations take into account the Kimberley Declaration adopted by the Summit of Indigenous Peoples on Sustainable Development, held in the territory of the Khoi-San People from 20 to 23 August 2002, as well as the Plan of Implementation of Indigenous Peoples on Sustainable Development, when States begin to implement the Plan of Implementation of the World Summit on Sustainable Development. The Permanent Forum, through the Economic and Social Council, invites United Nations agencies, bodies, funds and programmes to identify areas of work within their mandates for collaborative implementation with indigenous peoples’ Kimberly proposals, taking into account the report of the Commission on Sustainable Development on its eleventh session and the multi-year programme of work of the Commission, for the further implementation of Agenda 21 and the Johannesburg Plan of Implementation as well as the fulfillment of the Millennium Development Goals.

Consistent with articles 18 and 19 of the United Nations Declaration and in line with the implementation of the 2030 Agenda for Sustainable Development, with the call to “leave no one behind”, the Permanent Forum strongly recommend that States and funds, programmes and specialized agencies of the United Nations system ensure the disaggregation of data on the basis of indigenous identifiers/ethnicity and the full and effective participation of indigenous peoples in developing and monitoring national action plans and in all processes relating to the follow-up to and review of the implementation of the Sustainable Development Goals, including at the high-level political forum on sustainable development.

Alarmed at attempts to exclude indigenous peoples of Africa in the application of World Bank Operational Policy 4.10, the Permanent Forum recommends that the World Bank immediately initiate consultations with States and indigenous peoples in Africa as part of its safeguards policy review and ensure the application of safeguards to indigenous peoples of Africa, as directed by articles 19 and 41 of the Declaration.

The Permanent Forum reiterates its recommendation to adopt a programme of work on article 8 (j) and other provisions of the Convention on Biological Diversity and strengthened institutional arrangements through a permanent subsidiary body to take forward the Kunming-Montreal Global Biodiversity Framework and to ensure a human rights-based approach, and full and effective participation of Indigenous Peoples, by the sixteenth meeting of the Conference of the Parties to the Convention. The Permanent Forum recommends ensuring direct access to financial resources for Indigenous Peoples, inclusive of all landscapes and seascapes, more efficient financial mechanisms managed by Indigenous Peoples and the inclusion of Indigenous Peoples’ representatives in the governance of the Framework to better design and implement grants. In that respect, the modus operandi and methods of work for enhanced Indigenous participation under article 8 (j) and related provisions The Permanent Forum reiterates its recommendation to adopt a programme of work on article 8 (j) and other provisions of the Convention on Biological Diversity and strengthened institutional arrangements through a permanent subsidiary body to take forward the Kunming-Montreal Global Biodiversity Framework and to ensure a human rights-based approach, and full and effective participation of Indigenous Peoples, by the sixteenth meeting of the Conference of the Parties to the Convention. Given increased violence against indigenous peoples in the Amazon region, the Permanent Forum urges the Member States of the region to take urgent, extraordinary and coordinated measures to protect the individual and collective rights of indigenous peoples, with the aim of maintaining their ownership and use of their territories. The Forum also calls upon the United Nations system and specialized agencies, including OHCHR, the United Nations Environment Programme, the United Nations Development Programme (UNDP), the Food and Agriculture Organization of the United Nations (FAO) and ILO, to support Member States in the protection of indigenous peoples’ habitats and cultures in the Amazon region in cooperation with indigenous peoples.

The Permanent Forum urges States to address the stark inequality between indigenous and non-indigenous people in all aspects of life, which has been heightened as a result of COVID-19, by implementing in full the Indigenous and Tribal Peoples Convention, 1989 (No. 169), the United Nations Declaration on the Rights of Indigenous Peoples and the American Declaration on the Rights of Indigenous Peoples in all their legal norms and public policies related to indigenous peoples.

The Forum recommends that immediate steps be taken within the framework of the Commission on Sustainable Development to protect water from privatization and from bilateral and multilateral governmental agreements and other incursions that affect the integrity of waters and impoverish communities, particularly indigenous women. The Forum recommends that the Commission appoint a special rapporteur for the protection of water to gather testimony directly from indigenous communities of the world impacted by or targeted for water privatization, diversion, toxic contamination, pollution, commodification and other environmental injustices that damage natural and potable water supplies

The Permanent Forum encourages Member States, in cooperation with United Nations agencies, to develop social policies that will enhance the production of indigenous peoples’ traditional foods and promote the restoration or recovery of lost drought-resistant indigenous food varieties to ensure food security. In this context, the Forum recommends that Burkina Faso, Mali and the Niger, as well as United Nations agencies such as FAO, IFAD and the Office for the Coordination of Humanitarian Affairs, establish a committee, in full consultation with and with the participation of indigenous peoples, aimed at preventing food crises in the sub Saharan region where indigenous peoples reside. The committee’s objective should be to prevent humanitarian disasters and, in particular, to prevent starvation at the same level as the disaster that struck the region in 1973.

The Permanent Forum recommends that the Office of the United Nations High Commissioner for Human Rights (OHCHR) promote the elaboration of a report on the impacts of climate change and indigenous peoples by the special rapporteur on the situation of human rights and fundamental freedoms of indigenous people.
