The Permanent Forum recommends that the Human Rights Council consider:(a)The inclusion of an agenda item addressing the human rights of indigenous peoples in the ongoing work of the Council;(b) Including the human rights of indigenous peoples as part of its universal periodic review;(c)The inclusion of indigenous expertise in the new general expert advisory body being established by the Human Rights Council;(d)The interventions submitted by an expert member of the Permanent Forum to the Human Rights Council and the working groups on the ongoing reforms of the human rights mechanisms;(e) Maintaining and strengthening its expertise on indigenous peoples’ human rights issues.

The Permanent Forum reiterates its recommendation to adopt a programme of work on article 8 (j) and other provisions of the Convention on Biological Diversity and strengthened institutional arrangements through a permanent subsidiary body to take forward the Kunming-Montreal Global Biodiversity Framework and to ensure a human rights-based approach, and full and effective participation of Indigenous Peoples, by the sixteenth meeting of the Conference of the Parties to the Convention. The Permanent Forum recommends ensuring direct access to financial resources for Indigenous Peoples, inclusive of all landscapes and seascapes, more efficient financial mechanisms managed by Indigenous Peoples and the inclusion of Indigenous Peoples’ representatives in the governance of the Framework to better design and implement grants. The Permanent Forum urges the funds, programmes and specialized agencies to have a special focus on the implementation of the United Nations Declaration on the Rights of Indigenous Peoples and the system-wide action plan in a few designated countries in 2017 and 2018 and led by the United Nations resident coordinators. In selecting those countries for joint action, special attention should be given to countries that already are under focus, such as those that are carrying out voluntary national reviews for the high-level political forum on sustainable development, those that are under review by the Working Group on the Universal Periodic Review, those that are in the preparatory phases for a new United Nations Development Assistance Framework, or those in which a dialogue process between the State and the indigenous peoples is taking place.

The Permanent Forum urges all States to commit to a process, with the participation of indigenous peoples, responding to the country reports of all United Nations special rapporteurs, including:
(a) Providing a written response to the rapporteur’s report, submitted to the Human Rights Council, within six months of the report’s issuance. The response should outline the State process for implementing the recommendations of the report;
(b) Developing and publicly promoting a strategy to implement the recommendations of the report within 12 months of its issuance;
(c) Providing annual updates of the rapporteur’s report detailing the implementation of the strategy until such time as the rapporteur conducts a new visit to the State in question, or until that State undergoes a universal periodic review.

The Permanent Forum reiterates its recommendation on indigenous peoples living in voluntary and semi-voluntary isolation, or “uncontacted”, from its fourth session, and urges Governments, indigenous peoples’ organizations, non-governmental organizations and multilateral bodies to take note of and implement the Belem Declaration on Isolated Indigenous Peoples of the Amazon and Gran Chaco, as well as International Labour Convention No. 169, domestic legislation and court orders that protect and maintain the rights of these indigenous peoples and their designated territories throughout the world to exist in isolation, should they so choose. The Permanent Forum urges Governments, the United Nations system, civil society and indigenous peoples’ organizations to cooperate in immediately ensuring effective prohibition against outside encroachment, aggression, forcible assimilation, and acts and processes of genocide. Measures of protection should comprise the safeguarding of their natural environment and livelihood and minimally invasive, culturally sensitive mobile health-care services.

Member States must urgently address violence against indigenous peoples, including State violence, gender-based violence, forced assimilation and forced child removals, discrimination in the justice system and other forms of discrimination, including discrimination based on gender, religion, disability, age and LGBTIQ identity. The Forum encourages the Expert Mechanism, at its earliest convenience, to engage with the Governments of Australia and New Zealand, and with the participation of indigenous peoples, regarding the removal of indigenous children.
