The Permanent Forum takes note of the under the auspices of a steering committee consisting of the Women's Refugee Commission, Equality Now, Equal Rights Trust, Tilburg University, the Office of the United Nations High Commissioner for Refugees and the United Nations Entity for Gender Equality and the Empowerment of Women (UN-Women). The Forum therefore calls upon those Member States whose constitutional provisions and legislation require review, as a matter of urgency, to support this global campaign, consistent with the Declaration and the rights of indigenous women highlighted in articles 21 and 22. The Permanent Forum supports the work of the Special Representative to urge States to integrate human rights into those areas that most affect business practices, including corporate law, export credit and insurance, investments and trade agreements. The Forum suggests that the Special Representative urge States to ensure that such business practices comply with the relevant provisions of the United Nations Declaration on the Rights of Indigenous Peoples. The Forum urges the Special Representative to incorporate the specific views and distinct perspectives of indigenous peoples on social and economic development. Regarding the Americas, corporations must also comply with therulings of the Inter-American Court of Human Rights, which construe the States’ obligations under International Labour Organization (ILO) Convention (No. 169) concerning Indigenous and Tribal Peoples in Independent Countries with regard to the Declaration as extending even to States that have not ratified the Convention. The Forum recommends that this principle be applied in other jurisdictions.

The Permanent Forum recommends that States formally recognize shifting cultivation as a traditional occupation for indigenous peoples that is closely related to their social and cultural identity and integrity and take effective measures to stop all discriminatory acts targeted at indigenous peoples’ practice of shifting cultivation in line with the provisions of ILO Conventions Nos. 169 and 111, ILO Recommendation No. 104 and the United Nations Declaration on the Rights of Indigenous Peoples, including through the delineation and the titling of the territories and lands concerned.

The Permanent Forum urges the World Food Programme to respect the habitual diet of indigenous peoples and to avoid the introduction of foreign foods of low nutritional quality in indigenous peoples’ communities. Furthermore, the Permanent Forum urges the World Food Programme to ensure that its methods of intervention are sensitive to indigenous peoples’ social fabric and respectful of their perceptions of the humanitarian-development nexus.

The Permanent Forum commends the UNDP Regional Bureau for Latin America and the Caribbean for starting a regional initiative building on the Programme’s experience in Asia. The Forum recommends that the initiative be consolidated and that the Regional Bureau implement a regional programme to ensure cross-fertilization of good practices among countries and coherent policy approaches. The Forum encourages the Regional Bureau to strengthen its capacity and, together with the Inter-Agency Support Group, looks forward to supporting those efforts through specialized training workshops for United Nations country teams.

The United Nations Declaration on the Rights of Indigenous Peoples should serve as a key and binding framework in the formulation of plans for development and should be considered fundamental in all processes related to climate change at the local, national, regional and global levels. The safeguard policies of the multilateral banks and the existing and future policies on indigenous peoples of United Nations bodies and other multilateral bodies should be implemented in all climate change-related projects and programmes.

The Permanent Forum requests that UNICEF design, in partnership with other relevant United Nations agencies, a protocol for emergency situations resulting from natural disasters to ensure that, in cases of emergency, there are no violations of the human rights of indigenous peoples, especially indigenous youth, children and women, owing to forced relocation.
