The Permanent Forum calls on States to ensure that indigenous peoples that are undertaking their own mitigation measures are provided with policy support, technical assistance, funding and capacity-building in order to deepen their knowledge on climate change and to allow them to implement more effective mitigation and adaptation strategies. They should gain benefits from the environmental services derived from their territories and resources. Processes and mechanisms for the valuation of these environmental services, and methods that allow them to get adequate benefits, should be developed jointly with them. Efforts to create better documentation of good practices in mitigation and adaptation and to replicate and upscale these practices should likewise be supported.

The Permanent Forum notes that the Constitutional Court of Guatemala issued ruling No. 2112-2016 of 24 October 2017 on indigenous peoples’ intellectual collective property. The Permanent Forum urges Guatemala to comply with the ruling and to adopt laws and policies, respecting the free, prior and informed consent of indigenous peoples.

The Permanent Forum encourages APG to continue to give priority to its endeavours to eliminate the servitude and contemporary forms of slavery to which families and communities in Santa Cruz, especially in Alto Parapetí, and in Chuquisaca, are subjected. The Permanent Forum encourages APG, as the organization that represents the Guaraní people in the Plurinational State of Bolivia, to continue to give priority to combating these extremely serious human rights violations as part of its broader programme of reconstitution of the Guaraní people.

The Permanent Forum acknowledges and accepts the study on the situation of indigenous persons with disabilities, with a particular focus on challenges faced with regard to the full enjoyment of human rights and inclusion in development (E/C.19/2013/6). The Forum recommends that the Committee on the Rights of Persons with Disabilities pay special attention, and take immediate action to respond, to the situation of indigenous persons and peoples with disabilities and encourage the United Nations system to facilitate the translation of the Convention on the Rights of Persons with Disabilities into indigenous and other languages.

Considering the commitment made by the World Bank at the Conference on Poverty Reduction and Indigenous Peoples (New York, 9 and 10 May 2006) to further explore inter-agency mechanisms to support the inclusion of indigenous peoples in national poverty reduction strategies in a limited number of pilot countries, the Permanent Forum recommends that Governments, indigenous organizations, United Nations organizations and bilateral donors fully contribute to that initiative and report back to the Permanent Forum on the progress made and the opportunities and limitations encountered, with a view to replicating the initiative in other countries.

The Permanent Forum thanks the Government of Colombia for its support during the Forum mission to Colombia and requests that the Government, the United Nations country team and the United Nations agencies involved in the mission implement the recommendations contained in the mission report (E/C.19/2011/3) through consultation and full collaboration with the indigenous peoples concerned. The Permanent Forum intends to assess the implementation of the recommendations at its eleventh session.

The Permanent Forum welcomes the effort of the Association of Southeast Asian Nations (ASEAN) to establish a regional human rights mechanism and offers its expertise and cooperation in this matter. The Forum recommends that the mechanism be called the “ASEAN Human Rights Commission” and that the commission explicitly recognize indigenous peoples in its terms of reference. We look forward to a strong commission with full investigatory and implementation powers, which uses the United Nations Declaration on the Rights of Indigenous Peoples as its framework in dealing with indigenous peoples’ issues. The Forum also recommends that the commission establish a committee on indigenous peoples in addition to its proposed committees on migrant workers and women and children.

The Permanent Forum recommends that the Special Programme of Research, Development and Research Training in Human Reproduction take the lead, in collaboration with OHCHR, UNFPA and WHO, in conducting an initial study on the global scope of past forced sterilization programmes of indigenous peoples and determine whether such programmes continue to exist, and report to the Forum at its nineteenth session on the progress made.
