The Permanent Forum recommends that national human rights institutions and other relevant national and regional bodies, including the African Commission on Human and Peoples’ Rights, promote the rights of indigenous peoples and monitor the implementation of the United Nations Declaration on the Rights of Indigenous Peoples, and ensure that the international standards on indigenous peoples’ rights are translated into national laws.

The Permanent Forum recommends that the World Bank brings its policy on indigenous peoples (OP 4.10) into full compliance with the United Nations Declaration on the Rights of Indigenous Peoples. The Forum attaches particular importance to the need for the Bank to adopt the standard of free, prior and informed consent and, in general, to institutionalize and operationalize an approach based on human rights. The Forum reiterates its recommendation, made at its twelfth session that the emerging instruments of the Bank and other agencies must be harmonized with the Declaration, which is regarded as a reflection of the minimum human rights standards necessary for the promotion and protection of indigenous peoples, nations and communities. Such instruments should be consistent with or exceed those minimum standards. The Forum underlines the need for the Bank’s operational policies to use language that is consistent with the Declaration.

The Permanent Forum reiterates its grave concerns about the situation of indigenous human rights defenders who continue to be harassed, criminalized, prosecuted or even killed for exercising their legitimate rights to protect their lands, territories and resources, especially in the context and activities of extractive industries. The Forum calls upon Member States to take a zero-tolerance approach to violence against indigenous human rights defenders, to develop and implement all measures necessary to respect and protect indigenous human rights defenders, to duly investigate any act against them and to prosecute those responsible to the full extent of the law.

The Durban Review Conference welcomed the adoption of the United Nations Declaration on the Rights of Indigenous Peoples, which should be used to combat racism against indigenous peoples. The Permanent Forum on Indigenous Issues decides to have a half-day session on the theme of “Addressing the elimination of racism against indigenous peoples”. This session will be held during the 2011 meeting of the Permanent Forum.

The Forum calls for an immediate halt to the criminalization,
incarceration, intimidation, coercion and assassination of, and death threats to, all indigenous human and environmental rights defenders.

The Permanent Forum encourages FAO to continue supporting indigenous peoples’ organizations in the field of communication for development. In particular, the Permanent Forum recommends that FAO continue to provide support for indigenous peoples’ communication platforms and their activities in the field of participatory territorial development and community-based adaptation to climate change. The Permanent Forum recommends that other United Nations agencies and donors join FAO in that important task and strengthen the reporting and monitoring mechanisms about indigenous peoples’ right to communication as a condition towards free and informed prior consent and self-determined development.

The Permanent Forum recognizes that many positive developments regarding the recognition of indigenous peoples and the need to protect and promote their rights have occurred over the past years and welcomes the leading role of the African Commission on Human and Peoples’ Rights and the Working Group on Indigenous Populations/Communities in Africa in recognizing indigenous peoples on the African continent and promoting their rights. Several African countries have also contributed to the development of the recognition of indigenous peoples. The Forum notes with appreciation the ratification in 2010 by the Central African Republic of the International Labour Organization (ILO) Convention concerning Indigenous and Tribal Peoples in Independent Countries (Convention No. 169); the passage by the Congo of Law No. 5-2011, on the promotion and protection of indigenous populations, and the establishment of a legal platform to address the situation of indigenous peoples in the country; the constitutional progress in Kenya in 2010; and the introduction of quotas for the Batwa indigenous people in Burundi and Rwanda. The practice by African States of supporting indigenous peoples’ rights is developing and should be encouraged.

The Permanent Forum welcomes the policy guides that are being developed by UN-Habitat, including on housing for indigenous peoples in the urban setting, which will be presented at the upcoming session of the World Urban Forum, to be held from 3 to 7 November 2008, in Nanjing, China. States are encouraged to support the production of the guidelines.
