The Permanent Forum welcomes the legal reforms and policies carried out in some States to recognize the right of indigenous peoples to food and food sovereignty. It would also like to encourage the remaining States to take the steps towards its recognition. The Permanent Forum encourages States to take positive actions to facilitate the capacity of indigenous peoples to strengthen traditional food systems, such as formally recognizing and demarcating indigenous territories to enable them to carry out productive food activities, in accordance with article
8 (2) (b) of the Declaration, which prohibits States from any action that has the aim or effect of dispossessing indigenous peoples of their lands, territories or resources.

The Permanent Forum welcomes information from the Government of Bangladesh on progress towards the implementation of the Chittagong Hill Tracts Peace Accord. It calls upon Bangladesh to make further efforts towards full implementation of the Accord through constructive dialogue and cooperation with the Chittagong Hill Tracts Regional Council, the three Hill District Councils and the Chittagong Hill Tracts Land Dispute Resolution Commission.

The Permanent Forum hails the adoption of the United Nations Declaration on the Rights of Indigenous Peoples by the General Assembly. The 13th of September 2007 is a historic day for the United Nations, indigenous peoples and States and marks the beginning of a new era of renewed partnerships for the promotion and protection of the human rights of all indigenous peoples and each indigenous person around the world. The Forum notes its new responsibility under the Declaration and pledges its commitment to making it a living document throughout its work. The Forum thus invites the international community as a whole, States, indigenous peoples, non-governmental organizations, the private sector, academia and the media to promote the Declaration and apply it in their policies and programmes for the improvement of indigenous peoples’ well-being around the world

The Permanent Forum has paid particular attention to the significant increase in the infrastructure budget of the World Bank, from $15 billion to $45 billion in 2009, for the primary economies of developing States. The implications of this development in relation to the respect and protection of indigenous peoples’ rights have to be clearly understood, and the imperative of getting the free, prior and informed consent of indigenous peoples affected by infrastructure projects has to be guaranteed. The Forum also urges the World Bank to provide additional operational budget to manage this large increase in infrastructure spending. The Permanent Forum reiterates its previous recommendations that the World Bank revise its operational safeguard policies to be consistent with the provisions of the United Nations Declaration on the Rights of Indigenous Peoples.

The Permanent Forum urges States to prepare reports on the actions taken to address the recommendations of all United Nations special rapporteurs, in particular the Special Rapporteur on the rights of indigenous peoples, especially the recommendations made at the conclusion of country visits, and encourages States to monitor their progress in this regard, in collaboration with indigenous peoples, United Nations country teams and all other relevant parties. Furthermore, the Forum reiterates that national human rights institutions are encouraged to assist indigenous peoples, the Special Rapporteur on the rights of indigenous peoples and the Permanent Forum in the implementation of the Declaration.

The Permanent Forum recommends that States discontinue all sedentarization and other programmes that coerce indigenous peoples to forsake shifting cultivation for other modes of cultivation without their free, prior and informed consent. Alternative modes of cultivation ensure food sovereignty, livelihood security, health security, educational security and forest conservation and other safeguards.

The Permanent Forum recognizes and commends Australia and Colombia for changing their positions by endorsing the United Nations Declaration on the Rights of Indigenous Peoples, and calls upon the remaining States that are opposed to it, as well as those abstaining, to reverse their positions and endorse the Declaration so as to achieve full consensus.

With regard to the development of national action plans, as committed to by Member States at the World Conference on Indigenous Peoples, the Permanent Forum welcomes the adoption by the Government of El Salvador of a national action plan and encourages its full and effective implementation. The Forum strongly urges other States to follow this good practice and develop their own national action plans for the full implementation of the Declaration. The Forum also encourages States to review recommendations made at past sessions, renew efforts at their implementation and report on progress made by 2021. The Forum invites the United Nations system to support the efforts of Member States in this regard.

Owing to the particular vulnerability of indigenous peoples in conflict situations, the Permanent Forum recommends that the Department of Peacekeeping Operations of the Secretariat and regional peacekeeping forces factor the protection of indigenous peoples into analysis, planning and guidance on the protection of civilians.
