The Permanent Forum is concerned by the killings, violence and harassment targeted at indigenous human rights defenders, which are also frequently committed with impunity. The Permanent Forum is concerned that, despite international condemnation, these criminal acts of violence persist, especially in a small number of countries in South and Central America, Africa and Asia.

Private sector stakeholders should, in the application of their guidelines and safeguard policies, ensure the protection of the rights of indigenous peoples, as enshrined in the United Nations Declaration on the Rights of Indigenous Peoples. Respect for free, prior and informed consent is essential for enabling indigenous peoples to participate in and engage with private sector activities, including in forestry, agriculture, fishing and extractive industries.

The Permanent Forum notes the work of the Fund for the Development of Indigenous Peoples of Latin America and the Caribbean (FILAC) as a regional mechanism to provide support to indigenous peoples. The Forum recommends that Governments and international organizations encourage indigenous peoples to participate fully in the work of reconciliation and truth commissions. The Forum welcomes the contribution of a paper by the Division for the Advancement of Women on the work of the Committee on the Elimination of Discrimination against Women (see E/C.19/2004/CRP.7) and recommends that the Committee enhance its monitoring of the implementation of the Convention on the Elimination of Discrimination against Women regarding indigenous women, and that it prepare and adopt a general comment on indigenous women, with the full participation of indigenous women.

With regard to the development of national action plans, as committed to by Member States at the World Conference on Indigenous Peoples, the Permanent Forum welcomes the adoption by the Government of El Salvador of a national action plan and encourages its full and effective implementation. The Forum strongly urges other States to follow this good practice and develop their own national action plans for the full implementation of the Declaration. The Forum also encourages States to review recommendations made at past sessions, renew efforts at their implementation and report on progress made by 2021. The Forum invites the United Nations system to support the efforts of Member States in this regard.

The Permanent Forum recommends that the International Labour Organization (ILO) continue to work with the Forum, United Nations agencies, financial institutions, bilateral donors and other interested parties to further the inclusion of indigenous peoples’ rights in high-level development policies and poverty reduction strategy papers, such as by raising indigenous peoples’ issues with the Organization for Economic Cooperation and Development and its related Development Assistance Committee.

The Permanent Forum welcomes the legal reforms and policies carried out in some States to recognize the right of indigenous peoples to food and food sovereignty. It would also like to encourage the remaining States to take the steps towards its recognition. The Permanent Forum encourages States to take positive actions to facilitate the capacity of indigenous peoples to strengthen traditional food systems, such as formally recognizing and demarcating indigenous territories to enable them to carry out productive food activities, in accordance with article
8 (2) (b) of the Declaration, which prohibits States from any action that has the aim or effect of dispossessing indigenous peoples of their lands, territories or resources.
