In this regard, the Permanent Forum recommends that Member States and the United Nations system take due account of the outcome document and the conclusions of the World Conference on Indigenous Peoples, to be held in September 2014, given that this process is deeply interrelated with the post-2015 process and will set the context for future work on indigenous peoples’ issues.

Indigenous peoples have been a distinct constituency at the United Nations since 1977 and, with the adoption of the United Nations Declaration on the Rights of Indigenous Peoples by the General Assembly in 2007, their inherent rights were affirmed as the international minimum standard. The Permanent Forum reiterates the position of the Special Rapporteur on the rights of indigenous peoples, namely that it is unacceptable to undermine the status and standing of indigenous peoples by combining or equating them with non-indigenous entities such as minorities, vulnerable groups or local communities. Such attempts, whether by States or United Nations entities, are not acceptable and will be challenged by indigenous peoples and those mandated to defend their rights. The Permanent Forum urges all United Nations entities and States parties to treaties concerning the environment, biodiversity and the climate to eliminate the use of the term “local communities” in conjunction with indigenous peoples, so that the term “indigenous peoples and local communities” would be abolished.

The Permanent Forum recommends that international financial institutions adopt and incorporate the right of indigenous peoples to free, prior and informed consent, without qualification, into their safeguard policies and project-related instruments. International financial institutions must ensure that their clients and borrowers engage in processes with indigenous peoples affected by bank-financed projects to secure their free, prior and informed consent.

The Permanent Forum welcomes the recent entry into force of the Optional Protocol to the International Covenant on Economic, Social and Cultural Rights. The Forum encourages Member States to accede to the Optional Protocol and requests the Committee on Economic, Social and Cultural Rights to consider the preparation of a general comment on the economic, social and cultural rights of indigenous peoples.

The Permanent Forum welcomes the entry into force of the Regional Agreement on Access to Information, Public Participation and Justice in Environmental Matters in Latin America and the Caribbean (Escazú Agreement) on 22 April 2021 and urges those countries that have not yet signed and ratified the Agreement to do so at the earliest opportunity. The Forum also urges those countries that have ratified the Escazú Agreement to ensure its implementation.

The Permanent Forum recognizes that the United Nations has declared 2010 the International Year of Biodiversity and that indigenous peoples, as custodians of the Earth’s biodiversity, should be major players in actions planned for 2010. In that spirit, the Permanent Forum calls for close cooperation between the secretariat of the Convention on Biological Diversity and the Forum in promoting the International Year and in highlighting the role of indigenous peoples as custodians of biodiversity.
