The Permanent Forum has paid particular attention to the significant increase in the infrastructure budget of the World Bank, from $15 billion to $45 billion in 2009, for the primary economies of developing States. The implications of this development in relation to the respect and protection of indigenous peoples’ rights have to be clearly understood, and the imperative of getting the free, prior and informed consent of indigenous peoples affected by infrastructure projects has to be guaranteed. The Forum also urges the World Bank to provide additional operational budget to manage this large increase in infrastructure spending. The Permanent Forum reiterates its previous recommendations that the World Bank revise its operational safeguard policies to be consistent with the provisions of the United Nations Declaration on the Rights of Indigenous Peoples.

It is important to recognize that indigenous peoples themselves must claim ownership of their languages and direct the revitalization efforts of the languages, while States should support these efforts and facilitate the transmission of the languages by parents and grandparents to the younger generations.

The Permanent Forum heard from many Indigenous women’s organizations and networks, including the national movement of midwives, Nim Alaxik, of Guatemala, on its work for the rights of Indigenous women and girls and their contributions to ensuring access to comprehensive and culturally appropriate health care, including sexual and reproductive health. The Permanent Forum welcomes the 2019 ruling by the Constitutional Court of Guatemala on the promotion of actions that guarantee access to culturally appropriate sexual and reproductive health for women and the rights of midwives as guardians of ancestral knowledge and practices and recommends that the ruling be implemented by the State.

Special attention should be paid to indigenous peoples at the High-level Dialogue on International Migration and Development to be held during the sixty-first session of the General Assembly in New York on 14 and 15 September 2006. Given that indigenous peoples are closely tied to their communities, the impact exerted by their migration is often broader than that exerted by individual migration. In particular, indigenous migration affects the collective rights of indigenous communities and accordingly has consequences for entire communities.

The Permanent Forum further urges States to improve their collection of data on self-harm and suicide among indigenous children and youth, as well as on violence against indigenous women, boys and girls, to facilitate better understanding of the extent of the problem. States should commit to reducing the incidence of self-harm, violence and suicide among indigenous children and youth through the allocation of adequate resources to holistic prevention and support services, in partnership with indigenous peoples.

The Permanent Forum recognizes the particular concerns of African indigenous youth, who are striving against political, social and economic challenges, poverty, marginalization and a lack of capacity development and employment. The Permanent Forum calls upon, among others, the Economic Commission for Africa and the African Union, including the New Partnership for Africa’s Development, to provide adequate capacity-building programmes and opportunities to enable African indigenous youth, women and persons with disabilities to engage meaningfully with States and other key development players, including by organizing and sponsoring attendance at training sessions, conferences and other forums on indigenous issues.

The Permanent Forum takes note of the under the auspices of a steering committee consisting of the Women's Refugee Commission, Equality Now, Equal Rights Trust, Tilburg University, the Office of the United Nations High Commissioner for Refugees and the United Nations Entity for Gender Equality and the Empowerment of Women (UN-Women). The Forum therefore calls upon those Member States whose constitutional provisions and legislation require review, as a matter of urgency, to support this global campaign, consistent with the Declaration and the rights of indigenous women highlighted in articles 21 and 22. The Permanent Forum recommends that Member States continue to develop legislation to support genuine indigenous representation and participation in decision-making. Legislative measures that create practical, economic, legal and political difficulties for the establishment and functioning of indigenous organizations and institutions worldwide should be addressed in order to allow for cross-border and international cooperation between indigenous peoples of different countries and with and within international organizations on issues and processes affecting them.
