The Permanent Forum recommends that the organizations and bodies of the United Nations system and Member States organize a regional consultation with indigenous organizations and interested donors to develop a more coordinated, sustainable and longer-term programme in the region which has as its principal objective the strengthening of indigenous organizations so as to ensure that they have the technical capacity to engage with Governments and the international community on human rights.

The Permanent Forum notes the increasing operational activity of extractive industries and other large-scale development projects, including land grabbing, which is taking place on or near the territories of indigenous peoples in many African States, often without the involvement of indigenous peoples and without their free, prior and informed consent. The Forum recommends that African States must respect the United Nations Declaration on the Rights of Indigenous Peoples, in particular the right of indigenous peoples to free, prior and informed consent.

The Permanent Forum acknowledges the continuing negotiations between the Nordic States and the Sami peoples towards the adoption of a Nordic Sami convention. The Forum recommends that the minimum international human rights standards contained in the United Nations Declaration on the Rights of Indigenous Peoples be the framework for all negotiations concerning the convention and the harmonizing of Sami rights within Nordic countries. It urges Nordic States to recognize and respect the Sami peoples’ right to self-determination, to determine their own identity or membership of their institutions in accordance with their customs and their right not to be subjected to forced assimilation, consistent with articles 8 and 33 of the Declaration, the conclusions and recommendations of the Special Rapporteur on the rights of indigenous peoples and the Committee on the Elimination of Racial Discrimination (see CERD/C/FIN/CO/19, para. 13).

The Permanent Forum recommends that when planning, preparing and implementing its programmes and projects, IFAD conduct the necessary investigations so as to ensure that the particularities and cultural sensitivities of indigenous peoples involved in and affected by the programmes and projects are taken into account. The Permanent Forum underlines the fact that indigenous peoples are to be engaged as an active and equal partner in all processes and phases of programmes and projects.

The Permanent Forum encourages international financial institutions to establish policy mechanisms and programme frameworks requiring corporations to comply with the Guiding Principles on Business and Human Rights, which were unanimously endorsed by the Human Rights Council in 2011, in addition to the United Nations Declaration on the Rights of Indigenous Peoples, International Labour Organization Convention No. 169, the Convention on the Rights of the Child and the Convention on the Elimination of All Forms of Discrimination against Women.

The Permanent Forum emphasizes that the recognition, protection and promotion of indigenous peoples’ rights to lands, territories and resources will make a significant contribution to achieving not only Goals 1 and 2, but also all the Sustainable Development Goals. In this regard, the Forum urges Governments to take all measures necessary to protect indigenous peoples’ rights to their territories and resources in the framework of the 2030 Agenda.

The Permanent Forum requests the Office of the President of the sixty-eighth session of the General Assembly to maintain close communication with the Forum, through its secretariat, to facilitate the Forum’s contribution to the preparatory stages of the World Conference. The Permanent Forum reiterates its concern that reports developed and presented by many States on the implementation of the Millennium Development Goals and poverty reduction strategy papers still do not adequately include and address indigenous peoples nor do they include their participation, and therefore calls on States to rectify this weakness and on United Nations agencies to support their efforts. While the Millennium Development Goals provide an important international framework for addressing extreme poverty and health and social outcomes, the Permanent Forum recommends that it is vital that further work be undertaken to ensure that the related programmes reflect full appreciation and respect for the rights and aspirations of indigenous peoples. This work should utilize the results of the workshops on indicators.

Regarding the negotiations taking place at the sessions of the Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore of the World Intellectual Property Organization (WIPO), the Permanent Forum reiterates the urgent need to develop an instrument that responds to the current lack of adequate protection of traditional knowledge and recognizes indigenous peoples as equal stakeholders and the legitimate holders of their knowledge. The Forum calls upon the Intergovernmental Committee to fast-track the negotiations and to use its core budget to fund indigenous peoples’ participation in the deliberations.
