The Permanent Forum supports the work of the Special Representative to urge States to integrate human rights into those areas that most affect business practices, including corporate law, export credit and insurance, investments and trade agreements. The Forum suggests that the Special Representative urge States to ensure that such business practices comply with the relevant provisions of the United Nations Declaration on the Rights of Indigenous Peoples. The Forum urges the Special Representative to incorporate the specific views and distinct perspectives of indigenous peoples on social and economic development. Regarding the Americas, corporations must also comply with therulings of the Inter-American Court of Human Rights, which construe the States’ obligations under International Labour Organization (ILO) Convention (No. 169) concerning Indigenous and Tribal Peoples in Independent Countries with regard to the Declaration as extending even to States that have not ratified the Convention. The Forum recommends that this principle be applied in other jurisdictions.

The Permanent Forum welcomes the decision by the African Commission on Human and Peoples’ Rights to promote and protect the rights of non-dominant minorities in Africa, who are distinct from indigenous populations and/or communities. While recognizing the importance of the rights of persons belonging to minorities, the Permanent Forum is concerned that the expanded mandate could compromise the current Commission standards for promoting the rights of indigenous peoples. The Permanent Forum therefore urges the Commission to establish a separate working group on minority rights. The Permanent Forum calls on the Commission to work closely with it, indigenous peoples representatives from Africa, and United Nations entities to highlight and advance the recognition, rights and participation of indigenous peoples at the regional and national levels. Furthermore, the Permanent Forum recommends that the Commission designate a focal point on indigenous people

The Permanent Forum commits to facilitating informal online regional dialogues between Member States and indigenous peoples on autonomy and self-governance to support the development of guiding principles for the realization of the rights of indigenous peoples to autonomy and self-government. The Permanent Forum invites the Inter-Agency Support Group on Indigenous People’s Issues to participate in the organization of these regional dialogues and in the preparation of a discussion paper on this matter to be presented at the twenty-first session of the Forum. The Permanent Forum also invites the Group of Friends of Indigenous Peoples to encourage the active participation of Member States in this endeavour.
