Considering that some indigenous peoples are living in countries that do not have United Nations country offices and lack opportunities to cooperate and coordinate with the United Nations agencies in advancing their rights and well-being, the Permanent Forum invites the United Nations system to cooperate with indigenous peoples in those regions.

The Permanent Forum supports the work of the Special Representative to urge States to integrate human rights into those areas that most affect business practices, including corporate law, export credit and insurance, investments and trade agreements. The Forum suggests that the Special Representative urge States to ensure that such business practices comply with the relevant provisions of the United Nations Declaration on the Rights of Indigenous Peoples. The Forum urges the Special Representative to incorporate the specific views and distinct perspectives of indigenous peoples on social and economic development. Regarding the Americas, corporations must also comply with therulings of the Inter-American Court of Human Rights, which construe the States’ obligations under International Labour Organization (ILO) Convention (No. 169) concerning Indigenous and Tribal Peoples in Independent Countries with regard to the Declaration as extending even to States that have not ratified the Convention. The Forum recommends that this principle be applied in other jurisdictions.

The Permanent Forum recommends that the President of the General Assembly at its sixty-ninth session convene a two-day interactive thematic event immediately prior to the World Conference, with the participation of Member States and representatives of indigenous peoples, the Expert Mechanism on the Rights of Indigenous Peoples and the Special Rapporteur on the rights of indigenous peoples, to allocate more time for an interactive dialogue and build commitment from Member States, the United Nations system and other stakeholders, and the Permanent Forum.

Indigenous peoples have been a distinct constituency at the United Nations since 1977 and, with the adoption of the United Nations Declaration on the Rights of Indigenous Peoples by the General Assembly in 2007, their inherent rights were affirmed as the international minimum standard. The Permanent Forum reiterates the position of the Special Rapporteur on the rights of indigenous peoples, namely that it is unacceptable to undermine the status and standing of indigenous peoples by combining or equating them with non-indigenous entities such as minorities, vulnerable groups or local communities. Such attempts, whether by States or United Nations entities, are not acceptable and will be challenged by indigenous peoples and those mandated to defend their rights. The Permanent Forum urges all United Nations entities and States parties to treaties concerning the environment, biodiversity and the climate to eliminate the use of the term “local communities” in conjunction with indigenous peoples, so that the term “indigenous peoples and local communities” would be abolished.

The Permanent Forum recommends that all United Nations agencies, funds and programmes, as well as the African Commission on Human and Peoples’ Rights, integrate relevant provisions of the Declaration into their policies, programmes, projects and strategies.

The Permanent Forum expresses thanks to the Government of Finland for hosting its pre-sessional meeting for 2020. The Forum also expresses its thanks to the Governments of Bolivia (Plurinational State of), Canada, China, the Congo, Denmark, Guatemala, Mexico, Nicaragua, Norway, Peru, the Russian Federation, Spain and the United States of America, as well as the government of Greenland, for having hosted previous pre-sessional and intersessional meetings of the Forum. The Forum recommends that States that have not yet done so consider hosting such meetings in the future. It also requests that the secretariat of the Forum organize pre-sessional meetings for future sessions of the Forum.

The Permanent Forum commits to facilitating informal online regional dialogues between Member States and indigenous peoples on autonomy and self-governance to support the development of guiding principles for the realization of the rights of indigenous peoples to autonomy and self-government. The Permanent Forum invites the Inter-Agency Support Group on Indigenous People’s Issues to participate in the organization of these regional dialogues and in the preparation of a discussion paper on this matter to be presented at the twenty-first session of the Forum. The Permanent Forum also invites the Group of Friends of Indigenous Peoples to encourage the active participation of Member States in this endeavour.
