The year 2022 is the International Year of Artisanal Fisheries and Aquaculture. The Permanent Forum therefore recommends that FAO prepare a study on the impacts of industrial fishing on the rights of indigenous peoples in regard to traditional fishing. The Permanent Forum invites the Organization to share the findings of said study at the twenty-third session of the Permanent Forum, to be held in 2024.

The Permanent Forum decides to authorize a three-day international expert group workshop on indigenous peoples’ rights, corporate accountability and the extractive industries, and requests that the results of the meeting be reported to the Forum at its eighth session, in 2009. The report of that workshop can feed into the eighteenth and nineteenth sessions of the Commission on Sustainable Development, which will address the themes of mining, chemicals, waste management and sustainable consumption and production patterns, and contribute to the review by the eighteenth session of the Commission.

The Permanent Forum welcomes the study to examine challenges in the African region to protecting traditional knowledge, genetic resources and folklore prepared by Paul Kanyinke Sena (E/C.19/2014/2), acknowledges the support provided by the WIPO secretariat towards the completion of that study and, in this regard, calls upon the WIPO secretariat to extend its outreach and awareness-raising activities in respect of indigenous peoples, with a particular focus on African indigenous peoples so as to increase their awareness of WIPO processes, and to further develop culturally appropriate training and capacity-building materials for indigenous peoples consistent with article 41 of the Declaration.

The Permanent Forum notes the progress made in including indigenous peoples in several of the newly developed United Nations Sustainable Development Cooperation Frameworks developed in 2020 and the COVID-19 socioeconomic response plans. However, the Forum also notes the uneven inclusion of indigenous peoples in United Nations country programming consultations and development, and the lack of disaggregated data, which perpetuates their invisibility. The Forum reiterates that indigenous peoples should participate in the preparation of common country assessments as well as the Sustainable Development Cooperation Frameworks and that United Nations country teams should work with Governments to foster effective consultation with indigenous peoples.

6. The Permanent Forum congratulates the Food and Agriculture Organization of the United Nations (FAO) on the adoption of its policy on indigenous and tribal peoples and requests that FAO take measures towards the implementation of the policy at all levels, especially at the country level. Such measures include improving the capacity of FAO staff to work effectively with indigenous peoples and their organizations and establishing a mechanism for partnership. Further, the Permanent Forum requests that FAO involve it in the development of voluntary guidelines on the responsible governance of tenure of land, fisheries and forests. In addition, the Forum requests participation in the Committee on World Food Security and membership in the Committee’s advisory group.
