The Permanent Forum welcomes the adoption of the Global Plan of Action for Animal Genetic Resources. It requests FAO to give priority to strategic priority No. 6 (support indigenous and local production systems and associated knowledge systems of importance to the maintenance and sustainable use of animal genetic resources), and to further develop relevant approaches to implement it, including rights-based approaches and payment for services that support the custodianship of local breeds by indigenous peoples.

The Permanent Forum highlights that unprincipled positions and actions of States undermine indigenous peoples’ human rights and the United Nations Declaration and that such conduct prejudices indigenous peoples globally and serves to weaken the international human rights system. States must therefore take steps, in conjunction with indigenous peoples, to ensure that their commitments and obligations are not violated in other international forums, especially following the World Conference on Indigenous Peoples. In accordance with both the outcome document of the World Conference and the United Nations Declaration, States, in conjunction with indigenous peoples, should develop legislation and mechanisms at the national level to ensure that laws are consistent with the United Nations Declaration

The Forum recommends that FAO and the Sustainable Agricultural and Rural Development Initiative work further on the development of cultural indicators for identifying priorities and criteria and methodologies for the right to food and food security, with the participation of indigenous peoples, taking into account the protection and restoration of indigenous peoples' traditional food systems and their agrobiodiversity and associated traditional knowledge and livelihoods. The threats to sustaining such systems, such as monoculture cash crop production, mineral extraction, environmental contamination and genetically modified seeds and technology, should be addressed.

Indigenous peoples have a profound relationship with their environment. This includes their distinct rights to water. The Permanent Forum urges States to guarantee those rights, including the right to access to safe, clean, accessible and affordable water for personal, domestic and community use. Water should be treated as a social and cultural good, and not primarily as an economic good. The manner in which the right to water is realized must be sustainable for present and future generations. Moreover, indigenous peoples’ access to water resources on their ancestral lands must be protected from encroachment and pollution. Indigenous peoples must have the resources to design, deliver and control their access to water.

The Forum notes the preparation of the World Congress on Protected Areas, to be held in Durban, South Africa, in September 2003, which Forum members consider to be an important meeting calling for their attention and action. The Forum recommends that all laws, policies or work programmes on forests and protected areas guarantee, ensure and respect various aspects of indigenous peoples’ lives, such as their spiritual and cultural lives, lands and territorial rights, including sacred sites, needs and benefits, and recognize their rights of access to and control over the management of forests.

Education in the mother tongue and bilingual education, foremost in primary and secondary schools, lead to effective and long-term successful educational outcomes. The Permanent Forum urges States to fund and implement the Programme of Action for the Second International Decade of the World’s Indigenous Peoples, specifically in the following education-related objective. The Forum underlines the need for States to respect and promote indigenous peoples’ definitions of learning and education, founded on the values and priorities of the relevant indigenous peoples. The right to education is independent of State borders and should be expressed by indigenous peoples’ right to freely traverse borders, as supported by articles 9 and 36 of the United Nations Declaration on the Rights of Indigenous Peoples.

The Permanent Forum recommends that the recommendations and proposals that emerged from the consultations of indigenous peoples and the World Bank on the Forest Carbon Partnership Facility and other carbon funds, such as the BioCarbon Fund, be implemented by the Bank and other relevant agencies. Indigenous peoples should be effectively involved in the design, implementation and evaluation of the Forest Carbon Partnership Facility. Displacement and exclusion of indigenous peoples from their forests, which may be triggered by projects funded by the Partnership Facility, should be avoided at all costs. Indigenous peoples or their representatives should have a voice in and a vote on the decision-making body of the Partnership Facility and of other climate change funds that will have impacts on them. In the case of those who opt not to participate in reducing emissions from deforestation and degradation or in the projects supported by the Partnership Facility, their choice should be respected. The Forum calls on all parties to ensure that the United Nations Declaration on the Rights of Indigenous Peoples is implemented when undertaking these processes.

The high rate of indigenous children who are out of school requires urgent attention, in particular in respect of securing access by girls to high-quality and relevant education that respects the cultures and traditions of the communities and that is responsive to their needs. Given that many indigenous peoples live in regions that have been defined as geographically remote or inaccessible, and many services do not reach such indigenous and/or nomadic communities, there are also serious challenges regarding the long distances required to reach hospitals and health-care centres, which lead to higher maternal and infant mortality rates in indigenous communities. The Permanent Forum urges States to ensure that health and education services reach remote areas and meet the needs of nomadic peoples.

The Permanent Forum welcomes the $1.7 billion pledge in support of indigenous peoples made by Governments and private funders at the twenty-sixth session of the Conference of the Parties to the United Nations Framework Convention on Climate Change, held in Glasgow, United Kingdom of Great Britain and Northern Ireland. However, the Permanent Forum is concerned that this pledge does not adequately address the effects of climate change. An effective response to the challenges presented by global climate change requires a concerted effort that encompasses all seven sociocultural regions of the world. The Permanent Forum requests that the pledge-givers include indigenous peoples from all seven sociocultural regions as recipients and redefine the scope of their commitment so that the funding is not only about forests and land tenure, but also reflects indigenous peoples’ self-determination, the building of alliances and the strengthening of indigenous peoples’ local economies, governance systems and resource management strategies.
