The COVID-19 pandemic has had a devastating impact on the livelihoods of indigenous peoples, including nomadic peoples. Furthermore, the pandemic has exacerbated the plight of young women with regard to forced early marriage, female genital mutilation and lack of access to health care. The Permanent Forum calls on Member States to implement effective measures to address these challenges in their post-pandemic recovery efforts

In the light of the study by Ms. Toki on the relationship between indigenous peoples and the Pacific Ocean and the dire effects of climate change, such as forced relocation and the loss of culture and livelihood, on vulnerable small island Pacific States, the Permanent Forum recommends that United Nations entities, including UN-Oceans, the United Nations Framework Convention on Climate Change and UNESCO, in addition to the International Seabed Authority, comply with and implement the relevant articles of the United Nations Declaration (arts. 18, 27 and 32), so as to ensure the full and effective participation of indigenous peoples. This should include meaningful participation, such as dedicated indigenous representation within each of these United Nations entities, and regard for indigenous peoples’ world views.

In support of their country-level programming, and with a view to a deeper appreciation of indigenous peoples’ perceptions of such interventions, UNICEF and UNFPA should undertake a study on the social, cultural, legal and spiritual institutions of indigenous peoples and how these affect the rights of women and children as laid out in local, regional and global frameworks.

The Permanent Forum requests WHO, in cooperation with indigenous health providers, to conduct a study on the prevalence and causes of suicide among indigenous youth and on efforts being made, including culture-based approaches, to prevent suicide and promote mental health and wellness. The Forum recommends that the Inter-Agency Support Group on Indigenous Peoples’ Issues and WHO organize an expert group meeting to review policies and best practices with regard to engaging indigenous youth on the prevention of suicide.

The Forum welcomes the new initiatives undertaken by UNICEF with regard to indigenous children, in particular the ongoing development of a digest on the indigenous child, as well as a number of case studies aimed at understanding development programming to fulfill the rights of indigenous children. The Forum requests UNICEF to make the digest and the results of those studies available to the Forum at its third session.

The Permanent Forum is concerned by the killings, violence and harassment targeted at indigenous human rights defenders, which are also frequently committed with impunity. The Permanent Forum acknowledges the progress made on its recommendation to FAO and WHO to revise the International Code of Conduct on Pesticide Management to include Indigenous Peoples’ views. The Permanent Forum urges FAO and WHO to develop guidance notes on the risk of pesticide use in Indigenous Peoples’ territories, in consultation with Indigenous Peoples.

The inclusion and full and effective participation of Indigenous Peoples, as beneficiaries and partners in achieving the Sustainable Development Goals, while avoiding negative impacts on their rights are essential. The Permanent Forum recommends that States and relevant United Nations entities cooperate with Indigenous Peoples to fully consider their situations during the midpoint review at the Sustainable Development Goals Summit in 2023, including in the preparations at the high-level political forum on sustainable development.

Celebrating 22 years of the Convention on the Rights of the Child, which is the first legally binding international instrument affirming human rights for all children, the Permanent Forum welcomes the adoption of the third Optional Protocol to the Convention on the Rights of the Child on a communications procedure, enabling individual claims and the use of the examination process, and urges States to accede to this important instrument regarding children in the most vulnerable situations, many of whom are indigenous, to allow them access to recourse and redress.
