The Permanent Forum recommends that the Human Rights Council update and complete the United Nations study on treaties, agreements and other constructive arrangements between States and indigenous populations, including the possible appointment of a rapporteur to carry out this task and to provide regular reports to the Human Rights Council, the Permanent Forum and other appropriate bodies.

The Permanent Forum reiterates the importance of the legal recognition of
indigenous peoples within national constitutions. The Permanent Forum takes note of
the position expressed by the Government of Chile on the recognition of indigenous
peoples. The Permanent Forum invites Chile to provide an update on progress at the
twenty-second session of the Permanent Forum, to be held in 2023. Furthermore, the
Permanent Forum supports the call from indigenous peoples of Australia at the
meeting held in Uluru in 2017 for a process on the three core components of the Uluru
Statement from the Heart – “Voice, Treaty and Truth” – and constitutional recognition
of indigenous rights consistent with the United Nations Declaration on the Rights of
Indigenous Peoples.

The Permanent Forum recognizes that many positive developments regarding the recognition of indigenous peoples and the need to protect and promote their rights have occurred over the past years and welcomes the leading role of the African Commission on Human and Peoples’ Rights and the Working Group on Indigenous Populations/Communities in Africa in recognizing indigenous peoples on the African continent and promoting their rights. Several African countries have also contributed to the development of the recognition of indigenous peoples. The Forum notes with appreciation the ratification in 2010 by the Central African Republic of the International Labour Organization (ILO) Convention concerning Indigenous and Tribal Peoples in Independent Countries (Convention No. 169); the passage by the Congo of Law No. 5-2011, on the promotion and protection of indigenous populations, and the establishment of a legal platform to address the situation of indigenous peoples in the country; the constitutional progress in Kenya in 2010; and the introduction of quotas for the Batwa indigenous people in Burundi and Rwanda. The practice by African States of supporting indigenous peoples’ rights is developing and should be encouraged.

The Permanent Forum welcomes the United Nations Entity for Gender Equality and the Empowerment of Women (UN-Women) strategy of inclusion and visibility of indigenous women, which responds to the system-wide action plan on the rights of indigenous peoples and the recommendation of the Forum (E/2014/43/Corr.1-E/C.19/2014/11/Corr.1, para. 35) on including the priorities of indigenous women in global, regional and national programmes. The Forum encourages Member States to allocate sufficient funding for the implementation of the strategy. The Forum encourages UN-Women to emphasize enhancing the participation and capacities of indigenous young women and girls and to report on progress made to the Forum at its eighteenth session.

As a result of the loss of their lands, territories and resources due to development and other pressures, many indigenous peoples are forced to leave their traditional lands and territories and migrate within and between countries to escape conflict, persecution and the impact of climate change. Indigenous peoples’ mobility has become an increasingly complex issue in recent years. The Permanent Forum therefore invites Member States to fully implement the Global Compact for Safe, Orderly and Regular Migration adopted in December 2018, in line with the Declaration.

Taking into account the challenges faced by States in the implementation of their international obligation to consult with and obtain the free, prior and informed consent of indigenous peoples, the Permanent Forum commits itself to developing an international guide to facilitate the implementation of these principles in accordance with the standards established in the United Nations Declaration. The Forum invites the Expert Mechanism on the Rights of Indigenous Peoples and the Special Rapporteur on the rights of indigenous peoples to collaborate on this initiative.
