The Permanent Forum recalls the many recommendations that call for statistics on indigenous health. Data collection and disaggregation remain a challenge. In particular, the delivery of health care in rural and remote areas remains a major obstacle to the right to health. In addition, there remains an urgent need for more indigenous health professionals, mental health services and programmes addressing non-communicable diseases and reproductive health. In particular, the Forum reaffirms the recommendation of the eighth session that an expert group meeting on sexual health and reproductive rights be held.

The Permanent Forum welcomes the $1.7 billion pledge in support of indigenous peoples made by Governments and private funders at the twenty-sixth session of the Conference of the Parties to the United Nations Framework Convention on Climate Change, held in Glasgow, United Kingdom of Great Britain and Northern Ireland. However, the Permanent Forum is concerned that this pledge does not adequately address the effects of climate change. An effective response to the challenges presented by global climate change requires a concerted effort that encompasses all seven sociocultural regions of the world. The Permanent Forum requests that the pledge-givers include indigenous peoples from all seven sociocultural regions as recipients and redefine the scope of their commitment so that the funding is not only about forests and land tenure, but also reflects indigenous peoples’ self-determination, the building of alliances and the strengthening of indigenous peoples’ local economies, governance systems and resource management strategies.

The Permanent Forum recognizes the need to address the emergence of the mental health consequences of the pandemic. The consequences are being felt in all populations, but most acutely in populations that have traditionally been marginalized. The Forum calls for investments and preparations for mental and behavioural health interventions that are culturally adapted. Traditional medicines and practices can play a key role in the health of indigenous communities and individuals by encompassing a variety of dimensions, including the spiritual. The Forum calls on WHO, PAHO, States Members of the United Nations and indigenous peoples to work together to provide pathways for promoting mental health.

The Permanent Forum calls upon Member States, the bodies and organizations of the United Nations system, the United Nations funds and programmes, the Inter-Agency Support Group and, in particular, the United Nations country teams, indigenous peoples’ organizations and non-governmental organizations in consultative status with the Economic and Social Council, to report on the implementation of the Forum’s recommendations, especially by responding to the questionnaire prepared by the Forum secretariat.

Recognizing the deep spiritual relationship indigenous peoples have with water, and the great respect they have for the natural laws governing the health and the sanctity of water, the Permanent Forum recommends that States review, with the direct participation of indigenous peoples, their laws on water regulation and the treaties, land claims and self-government agreements that they have entered into with indigenous peoples, taking into account the sanctity of water reflected in those agreements. It is further recommended that States present their reviews to the eighth session of the Permanent Forum in 2009, including in particular, information on the status of the implementation of laws and agreements with respect to water and indigenous peoples.

The Permanent Forum welcomes the adoption of the Kunming-Montreal Global Biodiversity Framework at the fifteenth meeting of the Conference of the Parties to the Convention on Biological Diversity. The Permanent Forum urges the Conference of the Parties to establish a commission, as early as possible, to monitor and evaluate the implementation of the Framework, especially its target 3 on protecting 30 per cent of the planet’s land and water by 2030, with the full and equitable participation of Indigenous Peoples and respecting their rights to free, prior and informed consent. The establishment of robust grievance mechanisms is vital.

Considering their impact on the sexual health and reproductive rights of indigenous peoples, the Permanent Forum calls, in paragraph 62 of the report, for “a legal review of United Nations chemical conventions, in particular the Rotterdam Convention, to ensure that they are in conformity with international human rights standards, including the United Nations Declaration on the Rights of Indigenous Peoples and the Convention on the Rights of Persons with Disabilities”.

The Permanent Forum welcomes the adoption of resolution 63/278, by which the General Assembly established International Mother Earth Day and embraces indigenous peoples’ and Member States’ recommendations regarding the need to promote humankind living in harmony with nature. Therefore, the Forum decides to appoint Mr Carlos Mamani Candori and Mr Bartolome Clavero, members of the Forum as Special Rapporteurs, to conduct a study, without financial implications, on its implementation, taking into account, inter alia, the consideration and recognition of Mother Earth rights and submit a report to the ninth session of the Forum in 2010.

The Permanent Forum recommends that the World Health Organization (WHO), the Pan American Health Organization (PAHO), the United Nations Children’s Fund (UNICEF), States, non-governmental organizations and indigenous peoples’ organizations join efforts in implementing appropriate expert health-care actions to prevent disastrous disease problems affecting indigenous peoples in voluntary isolation and recent contact, and consider adopting rapid-effect emergency procedures in situations where the health situation is critical, as it is at present in the Javari Valley in Brazil.
