The Permanent Forum recommends that Governments and States promote the creation of conditions for indigenous peoples that will enable them to maintain the forests in their traditional way and conserve their cultural identity, with priority accorded to indigenous peoples in voluntary isolation, strengthening their capacities and highlighting the value of ancestral knowledge related to native forests. The Forum further recommends that the traditional knowledge and traditional forest management practices and governance systems of indigenous peoples for the protection and use of their forests be recognized in all forest policies and climate-related forest initiatives.

The Permanent Forum welcomes the fact that United Nations entities and bodies, including mandate holders and, notably, OHCHR and the United Nations Environment Programme, take their share of the responsibility to ensure a safe space for Indigenous Peoples participating in United Nations meetings. The Permanent Forum requests that United Nations bodies and entities create an urgent response mechanism to acts of intimidation and reprisals against Indigenous human rights defenders cooperating with the United Nations, in line with existing United Nations guidance on protection and promotion of civic space and the Secretary-General’s Call to Action for Human Rights. The Permanent Forum will consider how to strengthen its own response mechanisms and its cooperation with the Assistant SecretaryGeneral for Human Rights, in line with General Assembly resolution 77/203, on this pressing matter, including through the appointment of focal points.

The Forum encourages the Food and Agricultural Organization of the United Nations (FAO) to recognize the importance of and emphasize support for indigenous agricultural systems, including forestry, shifting cultivation, fisheries, livestock, pastoralism and hunting-gathering systems, and their associated biodiversity, foods, knowledge systems and cultures. The Forum recommends that the World Conservation Union Congress, to be held in November 2004 in Bangkok, endorse the recommendations on indigenous peoples and protected areas, as well as other relevant recommendations (such as on sacred sites) adopted by the Fifth World Parks Congress. It should also emphasize the need for the recognition of community conserved areas and indigenous peoples’ protected areas, the need for the full respect for indigenous peoples’ rights and the need for indigenous peoples’ free prior informed consent to be obtained before the declaration or in the management of any protected area which may affect them.

The Permanent Forum recommends that non-governmental organizations, indigenous peoples’ organizations and academics undertake independent studies and investigations into the violations of indigenous peoples’ land rights through illegal land expropriation and exploitation and into the issue of land, forestry, tourism and mining concessions, including:(a)Recommendations on how the rights of indigenous peoples can be legally protected;(b)The degree to which Governments ensure free, prior and informed consent of indigenous peoples in the approval of land concessions and mining exploration licences over their traditional lands and forests;(c)The role of other States in the promotion of agri-business and extractive industries without the free, prior and informed consent of indigenous peoples;(d)The role of multinational agri-business and extractive industries; specifically, whether corporate social responsibilities have been fulfilled and social and environmental impact assessments have been undertaken prior to the commencement of development projects.

The Permanent Forum learned of the threat posed to the health of indigenous peoples by four non-communicable diseases — diabetes, cardiovascular disease, cancer and chronic lung disease — and their common risk factors. The Permanent Forum welcomes the organization of a high-level meeting of the General Assembly on the prevention and control of non-communicable diseases and requests that representatives of indigenous peoples be invited to contribute to and participate in the meeting, as well as the interactive hearings with civil society scheduled for June 2011.

The Forum requests the Special Rapporteur on the human rights and fundamental freedoms of indigenous peoples to undertake a study on the United Nations decolonization process and on the Special Committee on Decolonization to assess its historical and current impact on the human rights of indigenous peoples of the non-self-governing territories. Furthermore, the Forum requests the Secretary-General to undertake a mid-decade review of the Second International Decade for the Eradication of Colonialism to determine whether substantial progress has been made in achieving the goals of the Second Decade and to identify proposals for addressing obstacles to achieving the goals of the Second Decade.
